    Amends the School Code. Provides that a General Assembly scholarship covers the payment of tuition and fees if amounts are appropriated for that purpose to the Illinois Student Assistance Commission (now, the scholarship exempts the holder from the payment of tuition and fees). Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Sections
5 30-12.5 and 30-13 as follows:
 
6     (105 ILCS 5/30-12.5)
7     Sec. 30-12.5. Waiver of confidentiality.
8     (a) As a condition of nomination for a General Assembly
9 scholarship under Section 30-9, 30-10, or 30-11, each nominee
10 shall provide to the member of the General Assembly making the
11 nomination a waiver document stating that, notwithstanding any
12 provision of law to the contrary, if the nominee receives a
13 General Assembly scholarship, then the nominee waives all
14 rights to confidentiality with respect to the contents of the
15 waiver document. The waiver document shall state at a minimum
16 the nominee's name, domicile address, attending university,
17 degree program in which the nominee is enrolled, amount of
18 tuition covered waived by the legislative scholarship and the
19 name of the member of the General Assembly who is making the
20 nomination. The waiver document shall also contain a statement
21 by the nominee that, at the time of the nomination for the
22 legislative scholarship, the domicile of the nominee is within
23 the legislative district of the legislator making the
24 scholarship nomination. The waiver document must be signed by
25 the nominee, and the nominee shall have his or her signature on
26 the waiver document acknowledged before a notary public. The
27 member of the General Assembly making the nomination shall file
28 the signed, notarized waiver document, together with the
29 nomination itself, with the State Superintendent of Education.
30 By so filing the waiver document, the member waives all his or
31 her rights to confidentiality with respect to the contents of
32 the waiver document.

1     (b) The legislative scholarship of any nominee shall be
2 revoked upon a determination by the State Board of Education
3 after a hearing that the nominee knowingly provided false or
4 misleading information on the waiver document. Upon revocation
5 of the legislative scholarship, the scholarship nominee shall
6 reimburse the Illinois Student Assistance Commission
7 university for the full amount of any tuition covered by the
8 scholarship waived prior to revocation of the scholarship.
9     (c) The Illinois Student Assistance Commission shall
10 prepare a form waiver document to be used as provided in
11 subsection (a) and shall provide copies of the form upon
12 request.

15     Sec. 30-13. The scholarships issued under Sections 30-9
16 through 30-12 of this Article may be used at the University of
17 Illinois, Southern Illinois University, Chicago State
18 University, Eastern Illinois University, Governors State
19 University, Illinois State University, Northeastern Illinois
20 University, Northern Illinois University, and Western Illinois
21 University as provided in those sections. Unless otherwise
22 indicated, these scholarships shall be good for a period of not
23 more than 4 years while enrolled for residence credit and,
24 subject to appropriation to the Illinois Student Assistance
25 Commission for this purpose, shall cover exempt the holder from
26 the payment of tuition and , or any matriculation, graduation,
27 activity, term or incidental fee, except any portion of a
28 multipurpose fee which is used for a purpose not covered by the
29 scholarship for which exemption is not granted under this
30 Section. The scholarship Exemption shall not cover be granted
31 from any other fees, including book rental, service,
32 laboratory, supply, union building, hospital and medical
33 insurance fees and any fees established for the operation and
34 maintenance of buildings, the income of which is pledged to the
35 payment of interest and principal on bonds issued by the

1 governing board of any university or community college.
2     Any student who has been or shall be awarded a scholarship
3 shall be reimbursed by the appropriate university or community
4 college for any fees which he has paid and for which the
5 scholarship covers exemption is granted under this Section, if
6 application for such reimbursement is made within 2 months
7 following the school term for which the fees were paid.
8     The holder of a scholarship shall be subject to all
9 examinations, rules and requirements of the university or
10 community college in which he is enrolled except as herein
11 directed.
12     This article does not prohibit the Board of Trustees of the
13 University of Illinois, the Board of Trustees of Southern
14 Illinois University, the Board of Regents of the Regency
15 Universities System and the Board of Governors of State
16 Colleges and Universities for the institutions under their
17 respective jurisdictions from granting other scholarships.
