1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Sections
5 27-24.4 and 27-24.5 as follows:
 
6     (105 ILCS 5/27-24.4)  (from Ch. 122, par. 27-24.4)
7     Sec. 27-24.4. Reimbursement amount. Each school district
8 shall be entitled to reimbursement, for each pupil, excluding
9 each resident of the district over age 55, who finishes either
10 the classroom instruction part or the practice driving part of
11 a driver education course that meets the minimum requirements
12 of this Act. Such reimbursement is payable from the Drivers
13 Education Fund in the State treasury.
14     Each year all funds appropriated from the Driver Education
15 Fund to the State Board of Education, with the exception of
16 those funds necessary for administrative purposes of the State
17 Board of Education, shall be distributed in the manner provided
18 in this paragraph to school districts by the State Board of
19 Education for reimbursement of claims from the previous school
20 year. As soon as may be after each quarter of the year, if
21 moneys are available in the Driver Education Fund in the State
22 treasury for payments under this Section, the State Comptroller
23 shall draw his or her warrants upon the State Treasurer as
24 directed by the State Board of Education. The warrant for each
25 quarter shall be in an amount equal to one-fourth of the total
26 amount to be distributed to school districts for the year.
27 Payments shall be made to school districts as soon as may be
28 after receipt of the warrants.
29     The base reimbursement amount shall be calculated by the
30 State Board by dividing the total amount appropriated for
31 distribution by the total of: (a) the number of students,
32 excluding residents of the district over age 55, who have

1 completed the classroom instruction part for whom valid claims
2 have been made times 0.2; plus (b) the number of students,
3 excluding residents of the district over age 55, who have
4 completed the practice driving instruction part for whom valid
5 claims have been made times 0.8.
6     The amount of reimbursement to be distributed on each claim
7 shall be 0.2 times the base reimbursement amount for each
8 validly claimed student, excluding residents of the district
9 over age 55, who has completed the classroom instruction part,
10 plus 0.8 times the base reimbursement amount for each validly
11 claimed student, excluding residents of the district over age
12 55, who has completed the practice driving instruction part. In
13 no case, however, shall the amount of reimbursement made on
14 account of any student exceed the per pupil cost to the
15 district of the classroom instruction part and the practice
16 driving instruction part combined. The school district which is
17 the residence of a pupil who attends a nonpublic school in
18 another district that has furnished the driver education course
19 shall reimburse the district offering the course, the
20 difference between the actual per capita cost of giving the
21 course the previous school year and the amount reimbursed by
22 the State.
23     By April 1 the nonpublic school shall notify the district
24 offering the course of the names and district numbers of the
25 nonresident students desiring to take such course the next
26 school year. The district offering such course shall notify the
27 district of residence of those students affected by April 15.
28 The school district furnishing the course may claim the
29 nonresident pupil for the purpose of making a claim for State
30 reimbursement under this Act.

33     Sec. 27-24.5. Submission of claims. The Claims for
34 reimbursement under this Act shall be submitted in duplicate by
35 each district to the State Board prior to October 1 of each

1 year on such forms and in such manner as shall be prescribed by
2 the State Board. Claims from the 1997-1998 school year that are
3 received after September 1, 1998 but before October 1, 1998,
4 and only these claims, shall be paid in the same manner as if
5 they were received before September 1, 1998. In addition to the
6 claim form, the district shall report on forms prescribed by
7 the State Board, on an ongoing basis, a list of students by
8 name, birth date and sex, with the date the behind-the-wheel
9 instruction or the classroom instruction or both were completed
10 and with the status of the course completion.
11     The State shall not reimburse any district for any student
12 who has repeated any part of the course more than once or who
13 did not meet the age requirements of this Act during the period
14 that the student was instructed in any part of the drivers
15 education course; nor shall the State reimburse any district
16 for any resident of the district over age 55.

18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
