    Amends the School Code. Makes a technical change in a Section concerning the School Code's construction. Amends the Board of Higher Education Act. Makes a technical change in a Section concerning the creation of the Board of Higher Education.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 1-2 as follows:
 
6     (105 ILCS 5/1-2)  (from Ch. 122, par. 1-2)
7     Sec. 1-2. Construction. The The provisions of this Act, so
8 far as they are the same as those of any prior statute, shall
9 be construed as a continuation of such prior provisions, and
10 not as a new enactment.
11     If in any other statute reference is made to an Act of the
12 General Assembly, or a section of such an Act, which is
13 continued in this School Code, such reference shall be held to
14 refer to the Act or section thereof so continued in this Code.

16     Section 10. The Board of Higher Education Act is amended by
17 changing Section 2 as follows:

19     Sec. 2. There is created a Board of Higher Education to
20 consist of 15 members as follows: 10 members appointed by the
21 the Governor, by and with the advice and consent of the Senate;
22 one member of a public university governing board, appointed by
23 the Governor without the advice and consent of the Senate; one
24 member of a private college or university board of trustees,
25 appointed by the Governor without the advice and consent of the
26 Senate; the chairman of the Illinois Community College Board;
27 the chairman of the Illinois Student Assistance Commission; and
28 a student member selected by the recognized advisory committee
29 of students of the Board of Higher Education. Beginning on July
30 1, 2005, one of the 10 members appointed by the Governor, by

1 and with the advice and consent of the Senate, must be a
2 faculty member at an Illinois public university. The Governor
3 shall designate the Chairman of the Board to serve until a
4 successor is designated. The chairmen of the Board of Trustees
5 of the University of Illinois, the Board of Trustees of
6 Southern Illinois University, the Board of Governors of State
7 Colleges and Universities, and the Board of Regents of Regency
8 Universities shall cease to be members of the Board of Higher
9 Education on the effective date of this amendatory Act of 1995.
10 No more than 7 of the members appointed by the Governor,
11 excluding the Chairman, shall be affiliated with the same
12 political party. The 10 members appointed by the Governor with
13 the advice and consent of the Senate shall be citizens of the
14 State and shall be selected, as far as may be practicable, on
15 the basis of their knowledge of, or interest or experience in,
16 problems of higher education. If the Senate is not in session
17 or is in recess, when appointments subject to its confirmation
18 are made, the Governor shall make temporary appointments which
19 shall be subject to subsequent Senate approval.
