1 | AMENDMENT TO SENATE BILL 2684

2 | AMENDMENT NO. ______. Amend Senate Bill 2684 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Criminal Code of 1961 is amended by | ||||||
5 | changing Section 18-1 as follows:
| ||||||
6 | (720 ILCS 5/18-1) (from Ch. 38, par. 18-1)
| ||||||
7 | Sec. 18-1. Robbery.
| ||||||
8 | (a) A person commits robbery when he or she takes property, | ||||||
9 | except a
motor vehicle covered by Section 18-3 or 18-4,
from | ||||||
10 | the person or presence of another by the use of force or by
| ||||||
11 | threatening the imminent use of force.
| ||||||
12 | (b) Sentence.
| ||||||
13 | Robbery is a Class 2 felony. However, if the victim is 60 | ||||||
14 | years of age
or over or is a physically handicapped person, or | ||||||
15 | if the robbery is
committed
in a school or place of worship or | ||||||
16 | at an automatic teller machine or for the purpose of acquiring | ||||||
17 | the automatic teller machine card or identification number of | ||||||
18 | another , robbery is a Class 1 felony.

20 | Section 99. Effective date. This Act takes effect upon | ||||||
