AMENDMENT TO HOUSE BILL 159

2     AMENDMENT NO. ______. Amend House Bill 159 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Pension Code is amended by adding
5 Section 1-125 as follows:
 
6     (40 ILCS 5/1-125 new)
7     Sec. 1-125. Felony conviction. A member of the retirement
8 system established under Article 2 who is convicted of any
9 felony relating to, arising out of, or in connection with his
10 or her service as a participating member of that retirement
11 system may not receive any benefits provided in this Code,
12 including any benefit for service not related to the felony
13 conviction.
14     This Section shall not operate to impair any contract or
15 vested right acquired before the effective date of this
16 amendatory Act of the 95th General Assembly under any law or

1 laws continued in this Code, nor to preclude the right to a
2 refund.
3     All participants entering service after the effective date
4 of this amendatory Act of the 95th General Assembly are deemed
5 to have consented to the provisions of this Section as a
6 condition of participation in a retirement system or pension
7 fund established under this Code.

9     Section 10. The Illinois Pension Code is amended by
10 repealing Section 2-156.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.".
