SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/6-906   from Ch. 95 1/2, par. 6-906

    Amends the Driver's License Medical Review Law of the Illinois Vehicle Code. Provides that a person has a right to a hearing (rather than a right to request a hearing) before the Secretary of State if the person has used all possible review by the Driver's License Medical Advisory Board and the person's driver's license has been restricted, canceled, or denied. Provides that the person has the right to be present when the hearing is conducted. Provides that the Secretary of State shall prescribe procedures to be followed at a hearing in the presence of the person whose driver's license has been restricted, canceled, or denied. Effective immediately.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 6-906 as follows:
 
6     (625 ILCS 5/6-906)  (from Ch. 95 1/2, par. 6-906)
7     Sec. 6-906. Request for a hearing.
8     (a) After utilizing all possible review by the Board under
9 this Act or any regulation promulgated by the Secretary, any
10 person who has their driver's license restricted or canceled or
11 is otherwise denied a license has a right to request a hearing
12 under Section 2-118 of this Code and to be present when the
13 hearing is conducted. The request for a hearing shall be in
14 writing.
15     (b) The Secretary shall prescribe by rule and regulation
16 the procedures to be followed at the hearing, including
17 procedures to be followed at a hearing in the presence of the
18 person whose driver's license has been canceled or restricted
19 or who has been otherwise denied a license.

21     Section 99. Effective date. This Act takes effect upon
22 becoming law.
