AMENDMENT TO HOUSE BILL 298

2     AMENDMENT NO. ______. Amend House Bill 298 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Vehicle Code is amended by
5 changing Section 6-905 as follows:
 
6     (625 ILCS 5/6-905)  (from Ch. 95 1/2, par. 6-905)
7     Sec. 6-905. Medical evaluations of individuals under
8 review; scope of driving privileges; report to the Secretary.
9     (a) Within the scope of the case request, as sent by the
10 Secretary, a function of the Board shall be to make medical
11 evaluations of the individual under review and determine what
12 medical conditions exist that may impair the individual's
13 ability to operate a motor vehicle safely.
14     (b) Based on the medical evaluations and determination
15 under subsection (a) and in accordance with established
16 standards, the Board shall, among other things, indicate the

1 scope of driving privileges that would enable the individual
2 under review to operate a motor vehicle safely, including the
3 extent to which compensatory aids and devices must be used and
4 the need for ongoing review or evaluation.
5     (c) The findings, determination, and recommendations of
6 the Board or its subdivisions shall be forwarded to the
7 Secretary who, subject to subsections (d) and (e), shall then
8 take the action in accordance with the Board's recommendation.
9     (d) A person who contests the findings, determination, and
10 recommendation of the Board, if he or she has utilized all
11 possible review by the Board under this Code or any rules
12 adopted by the Secretary, has a right to a hearing under
13 Section 2-118 of this Code and to be present when the hearing
14 is conducted. The request for a hearing must be in writing.
15     (e) The Secretary shall prescribe by rule the procedures to
16 be followed at the hearing under subsection (d), including
17 procedures to be followed at a hearing in the presence of the
18 person contesting the findings, determination, and
19 recommendation of the Board.
