SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-342

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall prepare and distribute to health and maternal care providers written publications containing standardized, objective information about umbilical cord blood banking that is sufficient to allow a pregnant woman to make an informed decision about whether to participate in a public or private umbilical cord blood banking program. Sets out the types of information to be included in the written publications. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 2310-342 as follows:
 
7     (20 ILCS 2310/2310-342)
8     Sec. 2310-342. Umbilical cord blood donations.
9     (a) Subject to appropriations for that purpose, the
10 Department of Public Health shall, by January 1, 2008 2007,
11 prepare and distribute to health and maternal care providers
12 written publications containing standardized, objective
13 information about umbilical cord blood banking that is
14 sufficient to allow a pregnant woman to make an informed
15 decision about whether to participate in a public or private
16 umbilical cord blood banking program, including that include
17 the following information:
18         (1) An explanation of the difference between public and
19     private umbilical cord blood banking.
20         (2) The options available to a mother, after the
21     delivery of her newborn, relating to stem cells contained
22     in the umbilical cord blood, including:
23             (A) donating to a public bank;

1             (B) storing in a family umbilical cord blood bank
2         for use by immediate and extended family members;
3             (C) storing, for family use, through a family or
4         sibling donor banking program that provides free
5         collection, processing, and storage when there is a
6         medical need; and
7             (D) discarding the umbilical cord blood.
8         (3) (1) The medical processes involved in the
9     collection of umbilical cord blood.
10         (4) (2) The medical risks to a mother and her newborn
11     child of umbilical cord blood collection.
12         (5) (3) The current and potential future medical uses
13     and benefits of umbilical cord blood collection to a
14     mother, her newborn child, and her biological family.
15         (6) (4) The current and potential future medical uses
16     and benefits of umbilical cord blood collection to persons
17     who are not biologically related to a mother or her newborn
18     child.
19         (7) Medical or family history criteria that can impact
20     a family's consideration of umbilical cord blood banking.
21         (8) Costs associated with public and private umbilical
22     cord blood banking, including the family banking and
23     sibling donor programs when there is a medical need.
24         (5) Any costs that may be incurred by a pregnant woman
25     who chooses to make an umbilical cord blood donation.
26         (9) (6) Options for ownership and future use of the

1     donated material.
2         (10) (7) The availability in Illinois of umbilical cord
3     blood donations.
4     (b) The Department shall encourage health and maternal care
5 providers providing healthcare services to a pregnant woman,
6 when those healthcare services are directly related to her
7 pregnancy, to provide the pregnant woman with the publication
8 described under subsection (a) of this Section before her third
9 trimester.
10     (c) (b) In developing the publications required under
11 subsection (a), the Department of Public Health shall consult
12 with an organization of physicians licensed to practice
13 medicine in all its branches and consumer groups. The
14 Department shall update the publications every 2 years.
