AMENDMENT TO HOUSE BILL 668

2     AMENDMENT NO. ______. Amend House Bill 668 on page 1, by
3 replacing lines 4 and 5 with the following:
 
4     "Section 5. The Veterans Preference Act is amended by
5 changing Sections 1 and 3 as follows:
 
6     (330 ILCS 55/1)  (from Ch. 126 1/2, par. 23)
7     Sec. 1. In the employment and appointment to fill positions
8 in the construction, addition to, or alteration of all public
9 works undertaken or contracted for by the State, or by any
10 political subdivision thereof, preference shall be given to
11 persons who have been members of the armed forces of the United
12 States or who, while citizens of the United States, were
13 members of the armed forces of allies of the United States in
14 time of hostilities with a foreign country, and have served
15 under one or more of the following conditions:
16         (1) The veteran served a total of at least 6 months, or

1         (2) The veteran served for the duration of hostilities
2     regardless of the length of engagement, or
3         (3) The veteran served in the theater of operations but
4     was discharged on the basis of a hardship, or
5         (4) The veteran was released from active duty because
6     of a service connected disability and was honorably
7     discharged. But such preference shall be given only to
8     those persons who are found to possess the business
9     capacity necessary for the proper discharge of the duties
10     of such employment. No political subdivision or person
11     contracting for such public works is required to give
12     preference to veterans, not residents of such district,
13     over residents thereof, who are not veterans.
14     As used in this Section:
15         "Time of hostilities with a foreign country" means any
16     period of time in the past, present, or future during which
17     a declaration of war by the United States Congress has been
18     or is in effect or during which an emergency condition has
19     been or is in effect that is recognized by the issuance of
20     a Presidential proclamation or a Presidential executive
21     order and in which the armed forces expeditionary medal or
22     other campaign service medals are awarded according to
23     Presidential executive order.
24         "Armed forces of the United States" means the United
25     States Army, Navy, Air Force, Marine Corps, or Coast Guard,
26     United States Reserve Forces, or Illinois National Guard.

1     Service in the Merchant Marine that constitutes active duty
2     under Section 401 of federal Public Law 95-202 shall also
3     be considered service in the Armed Forces of the United
4     States for purposes of this Section.
