AMENDMENT TO HOUSE BILL 699

2     AMENDMENT NO. ______. Amend House Bill 699 on page 7, line
3 12, by replacing "(h) In" with "(h) Except as provided in
4 subsection (h-5) of this Section, in In"; and
 
5 on page 8, below line 4, by inserting the following:
 
6     "(h-5) The county board of Peoria County may adopt a
7 schedule of fees as may be necessary to mitigate the effects of
8 stormwater runoff based on actual costs. The fees shall not
9 exceed the cost of satisfying the onsite stormwater retention
10 or detention requirements of the adopted stormwater management
11 plan. The fees shall be used to finance activities undertaken
12 by the county or its included municipalities to mitigate the
13 effects of urban stormwater runoff by providing regional
14 stormwater retention or detention facilities, as identified in
15 the county plan. The county board shall provide for a credit or
16 reduction in fees for any onsite retention, detention, drainage

1 district assessments, or other similar stormwater facility
2 consistent with the stormwater management ordinance. All fees
3 collected by Peoria County under this subsection shall be held
4 in a separate fund, and shall be expended only in the watershed
5 within which they were collected. Nothing in this Section
6 prevents the county board of Peoria County from requiring
7 developers to satisfy onsite retention or detention pursuant to
8 any other local ordinance addressing erosion, sediment, or
9 stormwater control.".
