SYNOPSIS AS INTRODUCED:
 
20 ILCS 105/4.03   from Ch. 23, par. 6104.03

    Amends the Illinois Act on the Aging. Requires the Department to establish a nursing home prescreening program, without regard to income guidelines, to determine whether any persons who are in need of long term care (now, limited to Alzheimer's victims and the blind or disabled) may be cared for in their homes through home and community based services. Sets conditions on admission to a nursing home and payment and requires periodic reassessments.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Act on the Aging is amended by
5 changing Section 4.03 as follows:
 
6     (20 ILCS 105/4.03)  (from Ch. 23, par. 6104.03)
7     Sec. 4.03. Nursing home prescreening program. The
8 Department on Aging, in cooperation with the Department of
9 Human Services and any other appropriate State, local or
10 federal agency, shall, without regard to income guidelines,
11 establish a nursing home prescreening program to determine
12 whether any persons Alzheimer's Disease and related disorders
13 victims, and persons who are deemed as blind or disabled as
14 defined by the Social Security Act and who are in need of long
15 term care, may be satisfactorily cared for in their homes
16 through the use of home and community based services. Any
17 approval of admission to a nursing home for the first time
18 following discharge from a hospital shall be conditional and
19 shall expire after 28 days, so as to assess the progress of any
20 treatments or rehabilitation services and to assist persons to
21 select care options that meet their needs and reflect their
22 preferences. Continued nursing home occupancy will remain
23 conditional, with assessments made at 28-day intervals, for a

1 period up to 3 months, or until the Department, as designated
2 entity, or its representative makes a final decision for
3 continued nursing home placement or facilities return to the
4 home. Payments to a nursing home during one or more periods of
5 conditional approvals shall not be diminished. Case
6 coordination units under contract with the Department may
7 charge a fee for the prescreening provided under this Section
8 and the fee shall be no greater than the cost of such services
9 to the case coordination unit.
