SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.131

    Amends the School Code. Provides that if the amount that the State Board of Education will pay to a school district from fiscal year 2008 appropriations, as estimated on April 1, 2008, is less than the amount that the State Board paid to the district from fiscal year 2007 appropriations, then the State Board shall make a fiscal year 2008 transitional assistance payment to the district in an amount equal to the difference between the estimated amount to be paid from fiscal year 2008 appropriations and the amount paid from fiscal year 2007 appropriations. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 2-3.131 as follows:
 
6     (105 ILCS 5/2-3.131)
7     Sec. 2-3.131. Transitional assistance payments.
8     (a) If the amount that the State Board of Education will
9 pay to a school district from fiscal year 2004 appropriations,
10 as estimated by the State Board of Education on April 1, 2004,
11 is less than the amount that the State Board of Education paid
12 to the school district from fiscal year 2003 appropriations,
13 then, subject to appropriation, the State Board of Education
14 shall make a fiscal year 2004 transitional assistance payment
15 to the school district in an amount equal to the difference
16 between the estimated amount to be paid from fiscal year 2004
17 appropriations and the amount paid from fiscal year 2003
18 appropriations.
19     (b) If the amount that the State Board of Education will
20 pay to a school district from fiscal year 2005 appropriations,
21 as estimated by the State Board of Education on April 1, 2005,
22 is less than the amount that the State Board of Education paid
23 to the school district from fiscal year 2004 appropriations,

1 then the State Board of Education shall make a fiscal year 2005
2 transitional assistance payment to the school district in an
3 amount equal to the difference between the estimated amount to
4 be paid from fiscal year 2005 appropriations and the amount
5 paid from fiscal year 2004 appropriations.
6     (c) If the amount that the State Board of Education will
7 pay to a school district from fiscal year 2006 appropriations,
8 as estimated by the State Board of Education on April 1, 2006,
9 is less than the amount that the State Board of Education paid
10 to the school district from fiscal year 2005 appropriations,
11 then the State Board of Education shall make a fiscal year 2006
12 transitional assistance payment to the school district in an
13 amount equal to the difference between the estimated amount to
14 be paid from fiscal year 2006 appropriations and the amount
15 paid from fiscal year 2005 appropriations.
16     (d) If the amount that the State Board of Education will
17 pay to a school district from fiscal year 2007 appropriations,
18 as estimated by the State Board of Education on April 1, 2007,
19 is less than the amount that the State Board of Education paid
20 to the school district from fiscal year 2006 appropriations,
21 then the State Board of Education, subject to appropriation,
22 shall make a fiscal year 2007 transitional assistance payment
23 to the school district in an amount equal to the difference
24 between the estimated amount to be paid from fiscal year 2007
25 appropriations and the amount paid from fiscal year 2006
26 appropriations.

1     (e) If the amount that the State Board of Education will
2 pay to a school district from fiscal year 2008 appropriations,
3 as estimated by the State Board of Education on April 1, 2008,
4 is less than the amount that the State Board of Education paid
5 to the school district from fiscal year 2007 appropriations,
6 then the State Board of Education shall make a fiscal year 2008
7 transitional assistance payment to the school district in an
8 amount equal to the difference between the estimated amount to
9 be paid from fiscal year 2008 appropriations and the amount
10 paid from fiscal year 2007 appropriations.

13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
