SYNOPSIS AS INTRODUCED:
 
505 ILCS 80/12   from Ch. 5, par. 55.12

    Amends the Illinois Fertilizer Act of 1961. Provides that any person distributing fertilizer in this State shall provide the Director with a summary report of tonnage. Provides that persons engaged in the sale of ammonium nitrate shall obtain certain information upon its distribution, and keep that information for at least 2 years. Provides that any retailer of ammonium nitrate may refuse to sell ammonium nitrate to any person attempting to purchase ammonium nitrate (i) out of season, (ii) in unusual quantities, or (iii) under suspect purchase patterns. Effective July 1, 2007.

1     AN ACT concerning agriculture.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Fertilizer Act of 1961 is amended
5 by changing Section 12 as follows:
 
6     (505 ILCS 80/12)  (from Ch. 5, par. 55.12)
7     Sec. 12. Tonnage reports; records.
8     (a) Any person distributing fertilizer in this State shall
9 provide the Director with a summary report of tonnage on a
10 form, provided by the Director, for that purpose. The person
11 transacting, distributing or selling commercial fertilizer or
12 custom mix to a non-registrant will mail the Director a summary
13 report on or before the 10th day of each month covering
14 shipments made during the preceding month showing the following
15 information:
16 Name and county of the consignee and amount (tons) by grades
17 and analysis of commercial fertilizer or custom mix. This
18 report may be made on a special summary form provided by the
19 Director or other forms as approved by the Director. Specialty
20 fertilizer sold in packages weighing 5 pounds or less or in
21 container of 4000 cubic centimeters or less, shall be reported
22 but no inspection fee will be charged. No information furnished
23 under this Section shall be disclosed by the Department in such

1 a way as to divulge the operation of any person.
2     (b) Persons engaged in the sale of ammonium nitrate shall
3 obtain the following information upon its distribution:
4         (1) the date of distribution;
5         (2) the quantity purchased;
6         (3) the license number of the purchaser's valid State
7     or federal driver's license, or an equivalent number taken
8     from another form of picture identification approved for
9     purchaser identification by the Director; and
10         (4) the purchaser's name, current physical address,
11     and telephone number.
12     Any retailer of ammonium nitrate may refuse to sell
13 ammonium nitrate to any person attempting to purchase ammonium
14 nitrate (i) out of season, (ii) in unusual quantities, or (iii)
15 under suspect purchase patterns.
16     (c) Records created under this Section shall be maintained
17 for a minimum of 2 years. Such records shall be available for
18 inspection, copying, and audit by the Department as provided
19 under this Act.

21     Section 99. Effective date. This Act takes effect July 1,
