AMENDMENT TO HOUSE BILL 1958

2     AMENDMENT NO. ______. Amend House Bill 1958 by replacing
3 lines 24 through 26 on page 2 and all of page 3 with the
4 following:
5     "(e) The wireless telephone service provider shall give a
6 consumer a written statement of the consumer's rights under
7 this Section when a sale is made to which this Section applies.
8     (f) This Section does not apply to any repair to or
9 replacement of a phone that was damaged or failed to work
10 properly as a result of some action by the consumer. The types
11 of damage creating an inference of consumer action include, but
12 are not limited to, the following: equipment showing signs of
13 water (or other liquid) damage; equipment showing signs of
14 physical impact; a scratched or broken casing; forced
15 components or buttons; and other external damage.
16     (g) This Section does not apply to the quality or lack of
17 services, including, but not limited to, cellular or other
18 subscribed services available to the consumer, contractually

1 agreed upon rates, and equipment compatibility issues.
2     (h) A person who violates this Section commits an unlawful
3 practice within the meaning of this Act.".
