| AN ACT concerning civil law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Code of Civil Procedure is amended by |
5 |
| changing Section 12-103 as follows:
|
6 |
| (735 ILCS 5/12-103) (from Ch. 110, par. 12-103)
|

| Sec. 12-103. Representative capacity. A judgment entered |
8 |
| against a
person not as a result of a contract made by him or |
9 |
| her or a tort committed
by him or her but solely because he or |
10 |
| she is the
the holder of title to property
as receiver, trustee |
11 |
| of a specifically identified trust,
representative as defined |
12 |
| in Section 1-2.11 of the Probate Act of 1975,
or in any other |
13 |
| fiduciary capacity, shall be enforced only against property
|
14 |
| held in the particular representative capacity, but no judgment |
15 |
| shall be
enforced against nor shall the judgment constitute a |
16 |
| lien upon, other property
owned by such person, whether |
17 |
| individually or in some other designated identifiable
|
18 |
| representative capacity. |
