AMENDMENT TO HOUSE BILL 3453

2     AMENDMENT NO. ______. Amend House Bill 3453 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Horse Racing Act of 1975 is
5 amended by adding Section 34.2 as follows:
 
6     (230 ILCS 5/34.2 new)
7     Sec. 34.2. Automated teller machines.
8     (a) Each facility operated by an organization licensee and
9 inter-track wagering location licensee must have at least one
10 (A) automated teller machine (ATM), as defined in the Automated
11 Teller Machine Security Act, that allows a patron to deposit
12 moneys into his or her United States bank account and is
13 clearly marked with a sign or (B) clearly designated money
14 transfer station that allows the wire transfer of funds into
15 the patron's bank account.
16     (b) If a facility is unable to comply with subsection (a),

1 then the operator of the facility must shut off all ATM or
2 credit card withdrawal machines that allow a patron to withdraw
3 funds from his or her bank account. If the licensee proves
4 compliance with this Section to the Illinois Racing Board, then
5 the machines may be turned back on.
6     (c) If the Illinois Racing Board provides a notice of
7 noncompliance (either by certified or registered mail) to a
8 facility, then the facility must shut off all ATM or credit
9 card withdrawal machines within 10 business days after receipt
10 of the notice. If the facility does not shut off all ATM or
11 credit card withdrawal machines within 10 business days, then
12 the licensee shall be assessed a civil penalty of $1,000 per
13 ATM or credit card withdrawal machine at the facility for each
14 week the facility is in violation of this subsection (c).
15     (d) The fines collected under this Section shall be
16 deposited into the Common School Fund.
17     (e) The Illinois Racing Board shall adopt any rules
18 necessary for the implementation and enforcement of this
19 Section.
 
20     Section 10. The Riverboat Gambling Act is amended by adding
21 Section 13.2 as follows:
 
22     (230 ILCS 10/13.2 new)
23     Sec. 13.2. Automated teller machines.
24     (a) Each riverboat or the home dock of the riverboat

1 operated by an owners licensee must have at least one (A)
2 automated teller machine (ATM), as defined in the Automated
3 Teller Machine Security Act, that allows a patron to deposit
4 moneys into his or her United States bank account and is
5 clearly marked with a sign or (B) clearly designated money
6 transfer station that allows the wire transfer of funds into
7 the patron's bank account.

23 licensee is in violation of this subsection (c).
