1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Flag Display Act is amended by adding
5 Section 10 as follows:
 
6     (5 ILCS 465/10 new)
7     Sec. 10. Death of resident military member or law
8 enforcement officer.
9     (a) The Governor shall issue an official notice to fly the
10 following flags at half-staff upon the death of a resident of
11 this State killed (i) by hostile fire as a member of the United
12 States armed forces or (ii) in the line of duty as a law
13 enforcement officer: the United States national flag, the State
14 flag of Illinois, and, in the case of the death of the member
15 of the United States armed forces, the appropriate military
16 flag as defined in subsection (b) of Section 18.6 of the
17 Condominium Property Act. Upon the Governor's notice, each
18 person or entity required by this Act to ensure the display of
19 the United States national flag on a flagstaff shall ensure
20 that the flags described in the notice are displayed at
21 half-staff on the day designated for the resident's funeral and
22 the 2 days preceding that day.
23     (b) The Department of Veterans' Affairs shall notify the

1 Governor of the death by hostile fire of an Illinois resident
2 member of the United States armed forces. The Department of
3 State Police shall notify the Governor of the death in the line
4 of duty of an Illinois resident law enforcement officer. Notice
5 to the Governor shall include at least the resident's name and
6 Illinois address, the date designated for the funeral, and the
7 circumstances of the death.
8     (c) For the purpose of this Section, the United States
9 armed forces includes: (i) the United States Army, Navy, Marine
10 Corps, Air Force, and Coast Guard; (ii) any reserve component
11 of each of the forces listed in item (i); and (iii) the
12 National Guard.
 
13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
