1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nurse Practice Act is amended by changing
5 Section 55-5 as follows:
 
6     (225 ILCS 65/55-5)
7     (Section scheduled to be repealed on January 1, 2018)
8     Sec. 55-5. LPN education program requirements.
9     (a) All Illinois practical nurse education programs must be
10 reviewed by the the Board and approved by the Department before
11 the successful completion of such a program may be applied
12 toward meeting the requirements for practical nurse licensure
13 under this Act. Any program changing the level of educational
14 preparation or the relationship with or to the parent
15 institution or establishing an extension of an existing program
16 must request a review by the Board and approval by the
17 Department. The Board shall review and make a recommendation
18 for the approval or disapproval of a program by the Department
19 based on the following criteria:
20         (1) a feasibility study that describes the need for the
21     program and the facilities used, the potential of the
22     program to recruit faculty and students, financial support
23     for the program, and other criteria, as established by

1     rule;
2         (2) program curriculum that meets all State
3     requirements;
4         (3) the administration of the program by a Nurse
5     Administrator and the involvement of a Nurse Administrator
6     in the development of the program; and
7         (4) the occurrence of a site visit prior to approval.
8     (b) In order to obtain initial Department approval and to
9 maintain Department approval, a practical nursing program must
10 meet all of the following requirements:
11         (1) The program must continually be administered by a
12     Nurse Administrator.
13         (2) The institution responsible for conducting the
14     program and the Nurse Administrator must ensure that
15     individual faculty members are academically and
16     professionally competent.
17         (3) The program curriculum must contain all applicable
18     requirements established by rule, including both theory
19     and clinical components.
20         (4) The passage rates of the program's graduating
21     classes on the State-approved licensure exam must be deemed
22     satisfactory by the Department.
23     (c) Program site visits to an institution conducting or
24 hosting a practical nursing program may be made at the
25 discretion of the Nursing Coordinator or upon recommendation of
26 the Board.

1     (d) Any institution conducting a practical nursing program
2 that wishes to discontinue the program must do each of the
3 following:
4         (1) Notify the Department, in writing, of its intent to
5     discontinue the program.
6         (2) Continue to meet the requirements of this Act and
7     the rules adopted thereunder until the official date of
8     termination of the program.
9         (3) Notify the Department of the date on which the last
10     student shall graduate from the program and the program
11     shall terminate.
12         (4) Assist remaining students in the continuation of
13     their education in the event of program termination prior
14     to the graduation of the program's final student.
15         (5) Upon the closure of the program, notify the
16     Department, in writing, of the location of student and
17     graduate records storage.
