1     AN ACT concerning fire safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Fire
5 and Life Safety Device Act.
 
6     Section 5. Fire protection devices neither designed nor
7 capable of function.
8     (a) The manufacture, installation, or sale of any device or
9 object that reasonably appears to be a smoke detector,
10 sprinkler head, carbon monoxide alarm, heat detector, or any
11 other similar device used for life safety or fire protection
12 that is, in fact, neither designed nor capable of performing
13 such life safety or fire protection function, is prohibited.
14     (b) A person who violates this Act is guilty of a petty
15 offense and shall be fined a maximum of $100 for the first
16 offense, $500 for the second offense, and $1,000 for the third
17 or subsequent offense. Each day that a device or devices are
18 installed in violation of this Section constitutes a separate
19 offense.
20     (c) Inspectors employed by municipalities, fire protection
21 districts, and counties, those individuals who meet the
22 requirements of subsection (f) of Section 20 of the Fire
23 Sprinkler Contractor Licensing Act, and individuals licensed

1 under the Professional Engineering Practice Act of 1989 may
2 inspect devices described in subsection (a) to ensure
3 compliance with this Act. No such inspection shall be conducted
4 in any room or suite of rooms used for human habitation,
5 including any single family residence, living unit of a
6 multiple family residence, or living unit in a mixed use
7 building.
8     (d) Subsection (a) of this Section does not apply to sworn
9 law enforcement officers utilizing a facsimile smoke detector,
10 sprinkler head, carbon monoxide alarm, heat detector, or any
11 other similar device in furtherance of a criminal
12 investigation.
