AMENDMENT TO HOUSE BILL 4791

2     AMENDMENT NO. ______. Amend House Bill 4791, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Ticket Sale and Resale Act is amended by
6 changing Section 1 as follows:
 
7     (720 ILCS 375/1)  (from Ch. 121 1/2, par. 157.31)
8     Sec. 1. Sale of tickets other than at box office
9 prohibited; exceptions.
10     (a) It is unlawful for any person, firm or corporation,
11 owner, lessee, manager, trustee, or any of their employees or
12 agents, owning, conducting, managing or operating any theater,
13 circus, baseball park, place of public entertainment or
14 amusement where tickets of admission are sold for any such
15 places of amusement or public entertainment to sell or permit
16 the sale, barter or exchange of such admission tickets at any

1 other place than in the box office or on the premises of such
2 theater, circus, baseball park, place of public entertainment
3 or amusement, but nothing herein prevents such theater, circus,
4 baseball park, place of public entertainment or amusement from
5 placing any of its admission tickets for sale at any other
6 place at the same price such admission tickets are sold by such
7 theater, circus, baseball park or other place of public
8 entertainment or amusement at its box office or on the premises
9 of such places, at the same advertised price or printed rate
10 thereof.
11     (b) Any term or condition of the original sale of a ticket
12 to any theater, circus, baseball park, or place of public
13 entertainment or amusement where tickets of admission are sold
14 that purports to limit the terms or conditions of resale of the
15 ticket (including but not limited to the resale price of the
16 ticket) is unenforceable, null, and void if the resale
17 transaction is carried out by any of the means set forth in
18 subsections (b), (c), (d), and (e) of Section 1.5 of this Act.
19 This subsection shall not apply to a term or condition of the
20 original sale of a ticket to any theater, circus, baseball
21 park, or place of public entertainment or amusement where
22 tickets of admission are sold that purports to limit the terms
23 or conditions of resale of a ticket specifically designated as
24 seating in a special section for a person with a physical
25 disability.
26     (c) An original ticket seller must post on a publicly

1 available Internet website the following information in
2 connection with the sale, allocation, or distribution of
3 tickets to each event for which the seller is the original
4 seller as soon as possible in conjunction with the original
5 public sale:
6         (1) the number of tickets offered for sale to the
7     general public at each price level;
8         (2) the number of tickets allocated or distributed to
9     the original ticket seller or its agents at each price
10     level;
11         (3) the number of tickets sold, allocated, or
12     distributed to fan clubs at each price level;
13         (4) the number of tickets sold, allocated, or
14     distributed to the promoter or performer or their agents at
15     each price level; and
16         (5) the identity of the recipients of any tickets sold,
17     allocated, or distributed to anyone not listed in
18     paragraphs (1) through (4) of this subsection (c).
