Amends the Taxi Safety Act of 2007. Provides that a taxi driver must be 21 years of age or older, must have a valid Illinois driver's license, must have had a valid driver's license for at least 3 years, and must not have been convicted of certain offenses during the immediately preceding 3 year period. Also provides that if he or she, after becoming a taxi driver, is convicted of any of those offenses or ceases to be licensed, he or she must immediately cease operating a taxicab and the prohibition shall continue until specified conditions are met. Effective July 1, 2009.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Taxi Safety Act of 2007 is amended by |
5 |
| changing Section 5 as follows: |
6 |
| (625 ILCS 55/5) |

| Sec. 5. Requirements for the operation of taxicabs. |
10 |
| (a) The taxi driver's picture, the taxi driver's license or |
11 |
| registration number, and the taxicab medallion number or an |
12 |
| exterior identification number must be posted in a visible |
13 |
| location in each cab. |
14 |
| (b) There must be posted in a visible location in each |
15 |
| taxicab a telephone number for a passenger to call if the taxi |
16 |
| driver is operating the taxicab in a reckless manner. |
17 |
| (c) If a taxi driver collides with a pedestrian while |
18 |
| operating a taxicab, resulting in bodily injury, then any |
19 |
| responding law enforcement officers must test the taxi driver |
20 |
| for drug and alcohol use.

| (d) in addition to meeting any requirements that are |
22 |
| imposed by a unit of local government, a taxi driver must meet |
23 |
| all of the following requirements:

| (1) He or she must be 21 years of age or older.
|
2 |
| (2) He or she must have a valid Illinois driver's |
3 |
| license.
|
4 |
| (3) He or she must have had a valid driver's license |
5 |
| during the immediately preceding 3 year period. If he or |
6 |
| she, after becoming a taxi driver, ceases to have a valid |
7 |
| driver's license, he or she must immediately cease |
8 |
| operating a taxicab and the prohibition shall continue |
9 |
| until a period of 3 years has elapsed during which he or |
10 |
| she has had a valid driver's license.
|

| (4) He or she must not have been convicted of any of |
12 |
| the following offenses during the immediately preceding 3 |
13 |
| year period:
Section 11-401 (leaving the scene of a traffic |
14 |
| accident involving death
or personal injury), 11-501 |
15 |
| (driving under the influence), 11-503 (reckless
driving), |
16 |
| 11-504 (drag racing), or 11-506 (street racing) of the |
17 |
| Illinois Vehicle Code, or Section 9-3 (manslaughter
or |
18 |
| reckless
homicide) or 12-5 (reckless conduct arising from |
19 |
| the use of a motor
vehicle) of the Criminal Code of 1961. |
20 |
| If he or she, after becoming a taxi driver, is convicted of |
21 |
| any of the offenses specified in this subdivision (4), he |
22 |
| or she must immediately cease operating a taxicab and the |
23 |
| prohibition shall continue until a period of 3 years has |
24 |
| elapsed during which he or she has not been convicted of |
25 |
| any of the offenses specified in this subdivision (4). |
