AMENDMENT TO HOUSE BILL 5116

2     AMENDMENT NO. ______. Amend House Bill 5116, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Illinois Commission on Volunteerism and
6 Community Service Act is amended by changing Section 4 as
7 follows:
 
8     (20 ILCS 710/4)  (from Ch. 127, par. 3804)
9     Sec. 4. Operation.
10     (1) The Governor shall appoint a Director of the Commission
11 on Volunteerism and Community Service who shall serve at the
12 Governor's pleasure and who shall receive such compensation as
13 is determined by the Governor. The Director shall employ such
14 staff as is necessary to carry out the purpose of this Act. The
15 Commission, working in cooperation with State agencies,
16 individuals, local groups, and organizations throughout the

1 State, may undertake programs and activities which further the
2 purposes of this Act including, but not limited to, the
3 following:
4         (a) providing technical assistance to programs which
5     depend upon volunteers;
6         (b) initiating community service programs to meet
7     previously unmet needs in Illinois;
8         (c) promoting and coordinating efforts to expand and
9     improve the statewide community service network;
10         (d) recognizing outstanding community service
11     accomplishments;
12         (e) disseminating information to support community
13     service programs and to broaden community service
14     involvement throughout the State;
15         (f) implementing federally funded grant programs in
16     Illinois such as the National and Community Service Trust
17     Act.
18     (2) The Commission may, subject to appropriation from the
19 Illinois Service Education Award Grant Fund, award an Illinois
20 Service Education Award Grant to recipients of a national
21 service educational award, established under 42 U.S.C. Sec.
22 12602 and awarded by the Corporation for National Community
23 Service, which grant must be awarded only as a partial matching
24 grant.
25     An individual who successfully completes a required term of
26 full-time national service in an approved national service

1 position in this State may apply to receive an Illinois Service
2 Education Award Grant.
3     An Illinois Service Education Award Grant may be used for
4 any of the following purposes:
5         (a) To repay student loans associated with attending an
6     Illinois institution of higher learning, as defined in the
7     Higher Education Student Assistance Act.
8         (b) To pay all or part of the cost of attendance at an
9     Illinois institution of higher learning, as defined in the
10     Higher Education Student Assistance Act.
11         (c) To pay expenses incurred in participating in an
12     approved Illinois school-to-work program.
13         (d) Any other purpose for which the national service
14     educational award may lawfully be used.
15     The Illinois Service Education Award Grant Fund is created
16 as a special fund in the State treasury. All money in the Fund
17 shall be used, subject to appropriation, by the Commission for
18 the purposes of this subsection (2).
19     Notwithstanding any other rulemaking authority that may
20 exist, neither the Governor nor any agency or agency head under
21 the jurisdiction of the Governor has any authority to make or
22 promulgate rules to implement or enforce the provisions of this
23 amendatory Act of the 95th General Assembly. If, however, the
24 Governor believes that rules are necessary to implement or
25 enforce the provisions of this amendatory Act of the 95th
26 General Assembly, the Governor may suggest rules to the General

1 Assembly by filing them with the Clerk of the House and the
2 Secretary of the Senate and by requesting that the General
3 Assembly authorize such rulemaking by law, enact those
4 suggested rules into law, or take any other appropriate action
5 in the General Assembly's discretion. Nothing contained in this
6 amendatory Act of the 95th General Assembly shall be
7 interpreted to grant rulemaking authority under any other
8 Illinois statute where such authority is not otherwise
9 explicitly given. For the purposes of this amendatory Act of
10 the 95th General Assembly, "rules" is given the meaning
11 contained in Section 1-70 of the Illinois Administrative
12 Procedure Act, and "agency" and "agency head" are given the
13 meanings contained in Sections 1-20 and 1-25 of the Illinois
14 Administrative Procedure Act to the extent that such
15 definitions apply to agencies or agency heads under the
16 jurisdiction of the Governor.
17     (3) The Commission may receive and expend funds, grants and
18 services from any source for purposes reasonable and necessary
19 to carry out a coordinated plan of community service throughout
20 the State.

23 Section 5.710 as follows:
