1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Commission on Volunteerism and
5 Community Service Act is amended by changing Section 4 as
6 follows:
 
7     (20 ILCS 710/4)  (from Ch. 127, par. 3804)
8     Sec. 4. Operation.
9     (1) The Governor shall appoint a Director of the Commission
10 on Volunteerism and Community Service who shall serve at the
11 Governor's pleasure and who shall receive such compensation as
12 is determined by the Governor. The Director shall employ such
13 staff as is necessary to carry out the purpose of this Act. The
14 Commission, working in cooperation with State agencies,
15 individuals, local groups, and organizations throughout the
16 State, may undertake programs and activities which further the
17 purposes of this Act including, but not limited to, the
18 following:
19         (a) providing technical assistance to programs which
20     depend upon volunteers;
21         (b) initiating community service programs to meet
22     previously unmet needs in Illinois;
23         (c) promoting and coordinating efforts to expand and

1     improve the statewide community service network;
2         (d) recognizing outstanding community service
3     accomplishments;
4         (e) disseminating information to support community
5     service programs and to broaden community service
6     involvement throughout the State;
7         (f) implementing federally funded grant programs in
8     Illinois such as the National and Community Service Trust
9     Act.
10     (2) The Commission may, subject to appropriation from the
11 Illinois Service Education Award Grant Fund, award an Illinois
12 Service Education Award Grant to recipients of a national
13 service educational award, established under 42 U.S.C. Sec.
14 12602 and awarded by the Corporation for National Community
15 Service, which grant must be awarded only as a partial matching
16 grant.
17     An individual who successfully completes a required term of
18 full-time national service in an approved national service
19 position in this State may apply to receive an Illinois Service
20 Education Award Grant.
21     An Illinois Service Education Award Grant may be used for
22 any of the following purposes:
23         (a) To repay student loans associated with attending an
24     Illinois institution of higher learning, as defined in the
25     Higher Education Student Assistance Act.
26         (b) To pay all or part of the cost of attendance at an

1     Illinois institution of higher learning, as defined in the
2     Higher Education Student Assistance Act.
3         (c) To pay expenses incurred in participating in an
4     approved Illinois school-to-work program.
5         (d) Any other purpose for which the national service
6     educational award may lawfully be used.
7     The Illinois Service Education Award Grant Fund is created
8 as a special fund in the State treasury. All money in the Fund
9 shall be used, subject to appropriation, by the Commission for
10 the purposes of this subsection (2).
11     Notwithstanding any other rulemaking authority that may
12 exist, neither the Governor nor any agency or agency head under
13 the jurisdiction of the Governor has any authority to make or
14 promulgate rules to implement or enforce the provisions of this
15 amendatory Act of the 95th General Assembly. If, however, the
16 Governor believes that rules are necessary to implement or
17 enforce the provisions of this amendatory Act of the 95th
18 General Assembly, the Governor may suggest rules to the General
19 Assembly by filing them with the Clerk of the House and the
20 Secretary of the Senate and by requesting that the General
21 Assembly authorize such rulemaking by law, enact those
22 suggested rules into law, or take any other appropriate action
23 in the General Assembly's discretion. Nothing contained in this
24 amendatory Act of the 95th General Assembly shall be
25 interpreted to grant rulemaking authority under any other
26 Illinois statute where such authority is not otherwise

1 explicitly given. For the purposes of this amendatory Act of
2 the 95th General Assembly, "rules" is given the meaning
3 contained in Section 1-70 of the Illinois Administrative
4 Procedure Act, and "agency" and "agency head" are given the
5 meanings contained in Sections 1-20 and 1-25 of the Illinois
6 Administrative Procedure Act to the extent that such
7 definitions apply to agencies or agency heads under the
8 jurisdiction of the Governor.
9     (3) The Commission may receive and expend funds, grants and
10 services from any source for purposes reasonable and necessary
11 to carry out a coordinated plan of community service throughout
12 the State.

14     Section 10. The State Finance Act is amended by adding
15 Section 5.710 as follows:

17     Sec. 5.710. The Illinois Service Education Award Grant
18 Fund.
