AMENDMENT TO HOUSE BILL 5469

2     AMENDMENT NO. ______. Amend House Bill 5469, AS AMENDED,
3 with reference to page and line numbers of House Amendment No.
4 1, on page 1, line 14, by inserting after "entity," the
5 following:
6 "subject to the reporting requirements of 42 U.S.C. 13032,";
7 and
 
8 on page 2, by replacing lines 6 through 19 with the following:
9     "(a) the name, phone number, and email address; and
10     (b) the name of employer."; and
 
11 on page 4, by replacing lines 18 through 24 with the following:
12 "shall report or cause a report to be made pursuant to
13 subsections (b) and (c) such instance to a peace officer
14 immediately or as soon as reasonably possible. Failure to make
15 such report shall be a business offense with a fine of $1,000.
16     (b) Commercial film and photographic film processors shall

1 report or cause a report to be made to the local law
2 enforcement agency in which the image or images described in
3 subsection (a) are discovered.
4     (c) Computer technicians shall report or cause the report
5 to be made to the local law enforcement agency in which the
6 image or images described in subsection (a) are discovered or
7 to the Illinois Child Exploitation e-Tip Line at
8 reportchildporn@atg.state.il.us.
9     (d) Reports required by this Act shall include the
10 following information: (i) name, address, and telephone number
11 of the person filing the report; (ii) the employer of the
12 person filing the report, if any; (iii) the name, address and
13 telephone number of the person whose property is the subject of
14 the report; (iv) the circumstances which led to the filing of
15 the report.
16     (e) If a report is filed in accordance with the
17 requirements of 42 U.S.C. 13032, the requirements of this Act
18 will be deemed to have been met.
19     (f) A computer technician or an employer caused to report
20 child pornography under this Section is immune from any
21 criminal, civil, or administrative liability in connection
22 with making the report, except for willful or wanton
23 misconduct.
24     (g) For the purposes of this Section, a "computer"; and
