AMENDMENT TO HOUSE BILL 5729

2     AMENDMENT NO. ______. Amend House Bill 5729 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Child Care Act of 1969 is amended by
5 changing Section 3 and by adding Section 5.7 as follows:
 
6     (225 ILCS 10/3)  (from Ch. 23, par. 2213)
7     Sec. 3. (a) No person, group of persons or corporation may
8 operate or conduct any facility for child care, as defined in
9 this Act, without a license or permit issued by the Department
10 or without being approved by the Department as meeting the
11 standards established for such licensing, with the exception of
12 facilities for whom standards are established by the Department
13 of Corrections under Section 3-15-2 of the Unified Code of
14 Corrections and with the exception of facilities defined in
15 Section 2.10 of this Act, and with the exception of programs or
16 facilities licensed by the Department of Human Services under

1 the Alcoholism and Other Drug Abuse and Dependency Act.
2     (b) No part day child care facility as described in Section
3 2.10 may operate without written notification to the Department
4 or without complying with Sections 5.7 and Section 7.1.
5 Notification shall include a notarized statement by the
6 facility that the facility complies with state or local health
7 standards and state fire safety standards, and shall be filed
8 with the department every 2 years.
9     (c) The Director of the Department shall establish policies
10 and coordinate activities relating to child care licensing,
11 licensing of day care homes and day care centers.
12     (d) Any facility or agency which is exempt from licensing
13 may apply for licensing if licensing is required for some
14 government benefit.

17     Sec. 5.7. Emergency response plans. Every day care center,
18 part day child care facility, day care home, and group day care
19 home shall prepare and follow written plans for immediate
20 response in case of emergency. Evacuation plans shall identify
21 the exits from each area used for child care and shall specify
22 the evacuation route. Monthly fire drills shall be conducted
23 for the purpose of removing children from the facility or home
24 as quickly as possible. Tornado drills shall be conducted
25 monthly by day care homes and group day care homes and 2 times

1 per year by day care centers and part day child care facilities
2 for the purpose of getting children accustomed to moving to a
3 position of safety in the event of a tornado. Records shall be
4 maintained of the dates and times that drills required under
5 this Section are conducted.
 
6     Section 99. Effective date. This Act takes effect upon
7 becoming law.".
