1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Task
5 Forces on State Employed Nurses Act.
 
6     Section 5. Definitions. As used in this Act:
7     "Facility" means a correctional facility, youth
8 correctional facility, State-operated developmental center,
9 State-operated mental health facility or Illinois Veterans
10 Home.
11     "Nurse" means any advanced practice nurse or registered
12 professional nurse, as defined in the Nursing and Advanced
13 Practice Nursing Act, who receives an hourly wage and has
14 direct responsibility to carry out nursing care or related
15 duties.
 
16     Section 10. Facility Task Forces on State Employed Nurses.
17     (a) A Facility Task Force on State Employed Nurses is
18 created in each facility funded under the Department of
19 Corrections, the Department of Juvenile Justice, the
20 Department of Human Services, or the Department of Veterans'
21 Affairs. The purpose of each Facility Task Force is minimizing
22 mandatory overtime in Illinois' 24-hour direct care

1 facilities.
2     (b) Each Facility Task Force shall consist of the following
3 members:
4         (1) Labor relations personnel or personnel staff, or
5     both, in the facility.
6         (2) Representatives of the Illinois Nurses Association
7     employed in the facility.
8         (3) Administrative staff of the facility.
9     (c) Each Facility Task Force shall meet quarterly to
10 discuss options to reduce the amount of overtime, as well as
11 nurse staffing levels, including but not limited to creating an
12 interagency pool of nurses with part-time and traveling
13 registered nurses with intent to hire as State employed nurses.
14     (d) Each Facility Task Force shall report its findings to
15 the agency under which the facility is funded within 30 days of
16 each Facility Task Force meeting.
17     (e) Each Facility Task Force shall have its first meeting
18 by July 1, 2007 or within 60 days after adjournment of the 2007
19 regular legislative session.
 
20     Section 15. State Task Force on State Employed Nurses.
21     (a) A State Task Force on State Employed Nurses is created
22 to address the issue of minimizing mandatory overtime in
23 Illinois' 24-hour direct care facilities. The State Task Force
24 shall review the reports received by each agency as a result of
25 the Facility Task Force meetings.

1     (b) The State Task Force shall consist of the following
2 members:
3         (1) Representatives of the Department of Corrections.
4         (2) Representatives of the Department of Juvenile
5     Justice.
6         (3) Representatives of the Department of Human
7     Services.
8         (4) Representatives of the Department of Veterans'
9     Affairs.
10         (5) Four legislative members, appointed one each by the
11     President of the Senate, the Minority Leader of the Senate,
12     the Speaker of the House of Representatives, and the
13     Minority Leader of the House of Representatives.
14         (6) At least one representative from the Governor's
15     staff.
16         (7) Representatives from the Illinois Nurses
17     Association.
18         (8) Representatives of the administrative staff from
19     within the facilities.
20     (c) The State Task Force shall convene meetings twice each
21 year.
22     (d) A report shall be submitted to the General Assembly by
23 January 1, 2008, for the review and consideration of the
24 members.
 
25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
