AMENDMENT TO SENATE BILL 656

2     AMENDMENT NO. ______. Amend Senate Bill 656 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 2310-15 as follows:
 
7     (20 ILCS 2310/2310-15)  (was 20 ILCS 2310/55.02)
8     Sec. 2310-15. General supervision of health; delegation to
9 certified local health departments boards of health. To have
10 the general supervision of the interests of the health and
11 lives of the people of the State and to exercise the rights,
12 powers, and duties of those Acts that it is by law authorized
13 to enforce. The Department shall have the general authority to
14 delegate to certified local health departments county and
15 multiple-county boards of health the duties and powers under
16 those Acts it is authorized to enforce for the purpose of local

1 administration and enforcement. Upon accepting the delegation
2 of duties and powers, certified local health departments county
3 and multiple-county boards of health shall administer and
4 enforce the minimum program standards promulgated by the
5 Department under the provisions of those Acts. Certified local
6 health departments County and multiple-county boards of health
7 may establish reasonable fees for the permits, licenses, or
8 other activities performed under the delegation agreement.
9 Upon delegation of duties and powers, the The Department may
10 waive any portion of its fees established by statute or rule if
11 the county or multiple-county board of health accepts the
12 delegation.
