AMENDMENT TO SENATE BILL 1245

2     AMENDMENT NO. ______. Amend Senate Bill 1245, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Mental Health and Developmental
6 Disabilities Administrative Act is amended by changing
7 Sections 4.3 and 70 as follows:
 
8     (20 ILCS 1705/4.3)  (from Ch. 91 1/2, par. 100-4.3)
9     Sec. 4.3. Site visits and inspections.
10     (a) (Blank).
11     (b) The Department shall establish a system of regular and
12 ongoing annual on-site inspections, including unannounced
13 visits, of each facility under its jurisdiction. The
14 inspections shall be conducted by the Department's central
15 office to:
16         (1) Determine facility compliance with Department

1     policies and procedures;
2         (2) Determine facility compliance with audit
3     recommendations;
4         (3) Evaluate facility compliance with applicable
5     federal standards;
6         (4) Review and follow up on complaints made by
7     community mental health agencies and advocates, and on
8     findings of the Human Rights Authority division of the
9     Guardianship and Advocacy Commission; and
10         (5) Review administrative and management problems
11     identified by other sources; and .
12         (6) Identify and prevent abuse and neglect.

15     Sec. 70. Monitoring by closed circuit television. The
16 Department of Human Services as successor to the Department of
17 Mental Health and Developmental Disabilities may install
18 closed circuit televisions in quiet rooms in institutions
19 supervised or operated by the Department to monitor patients in
20 those quiet rooms. The Department shall study current and
21 potential uses of closed circuit television monitoring and
22 recording within institutions supervised or operated by the
23 Department for the purpose of preventing and identifying abuse
24 and neglect, and shall report to the General Assembly on or
25 before January 1, 2008, with recommendations on how to increase

1 the use of closed circuit television monitoring and recording
2 for purposes of preventing and identifying abuse and neglect.
3 Nothing in this Section shall be construed to supersede or
4 interfere with any current provisions in the Mental Health and
5 Developmental Disabilities Code concerning the observation and
6 monitoring of patients.
