SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/2-16   from Ch. 23, par. 2-16
305 ILCS 5/5-5.26 new

    Amends the Illinois Public Aid Code. Provides that a "service provider" includes other entities besides a person or a corporation. Provides that the Department of Healthcare and Family Services, by rule, shall establish a separate cost-based reimbursement rate for service providers to provide child and adult psychiatric services on an outpatient basis. Provides that this rate shall apply only to service providers that (i) are certified by the Illinois Department of Human Services under the Medicaid Community Mental Health Services Program and (ii) demonstrate a combined Medicaid, poverty, and uninsured patient population penetration rate of 60% or greater. Provides that the Department, by rule, shall develop a cost-reporting mechanism, which will form the basis for any reimbursements made to service providers for providing child and adult psychiatric services on an outpatient basis. Effective January 1, 2009.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 2-16 and by adding Section 5-5.26 as follows:
 
6     (305 ILCS 5/2-16)  (from Ch. 23, par. 2-16)
7     Sec. 2-16. "Service provider": A person, or corporation, or
8 entity who furnishes medical, educational, psychiatric,
9 vocational or rehabilitative services to a recipient under this
10 Code, but excluding an employee of the Illinois Department or a
11 County Department.

14     Sec. 5-5.26. Child and adult psychiatric services. The
15 General Assembly finds that direct access to psychiatric mental
16 health services for children and adults suffering from mental
17 illness will improve the quality of life for these individuals
18 and will contain health care costs by avoiding the need for
19 more costly inpatient hospitalization. Thus, it is the intent
20 of the General Assembly to ensure that service providers
21 providing child and adult psychiatric services on an outpatient
22 basis are adequately reimbursed for the cost of providing these

1 services. Therefore, the Department of Healthcare and Family
2 Services, by rule, shall establish a separate cost-based
3 reimbursement rate for service providers to provide child and
4 adult psychiatric services on an outpatient basis. This rate
5 shall apply only to service providers that (i) are certified by
6 the Illinois Department of Human Services under the Medicaid
7 Community Mental Health Services Program under 59 Ill. Adm.
8 Code 132 and (ii) demonstrate a combined Medicaid, poverty, and
9 uninsured patient population penetration rate of 60% or
10 greater. The Department, by rule, shall develop a
11 cost-reporting mechanism, which will form the basis for any
12 reimbursements made to service providers for providing child
13 and adult psychiatric services on an outpatient basis.
 
14     Section 99. Effective date. This Act takes effect January
15 1, 2009.
