SYNOPSIS AS INTRODUCED:
 
510 ILCS 50/6   from Ch. 8, par. 173

    Amends the Illinois Diseased Animals Act. Requires the Department of Agriculture to quarantine dogs testing positive for Brucella Canis and other dogs in contact with infected dogs. Sets forth conditions for releasing dogs from quarantine. Effective immediately.

1     AN ACT concerning animals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Diseased Animals Act is amended by
5 changing Section 6 as follows:
 
6     (510 ILCS 50/6)  (from Ch. 8, par. 173)
7     Sec. 6. Whenever quarantine is established in accordance
8 with the provisions of this Act, notice shall be given by
9 delivery in person or by mailing by registered or certified
10 mail, postage prepaid, to the owner or occupant of any premises
11 so quarantined. Such notice shall be written or printed, or
12 partly written and partly printed, with an explanation of the
13 contents thereof. Such quarantine shall be sufficiently proved
14 in any court by the production of a true copy of such notice of
15 quarantine together with an affidavit, sworn to by the officer
16 or employee of the Department who delivered or mailed such
17 notice, containing a statement that the original thereof was
18 delivered or mailed in the manner herein prescribed.
19     Every quarantine so established shall remain in effect
20 until removed by order of the Department. Any person aggrieved
21 by any quarantine may appeal to the Department which shall
22 thereupon sustain, modify or annul the quarantine as it may
23 deem proper. Quarantines will be removed when epidemiological

1 evidence indicates that the disease or contamination threat to
2 humans or other animals no longer exists.
3     Any dog testing positive for Brucella Canis and any other
4 dog that has been in contact with an infected dog shall be
5 quarantined by the Department. The AGID test shall be the
6 definitive test used to determine whether a dog is infected
7 with Brucella Canis. Dogs placed under quarantine shall be
8 released when all of the following conditions have been met:
9         (1) All test-positive dogs have either been euthanized
10     or isolated from test-negative dogs.
11         (2) All dogs 12 weeks of age and older have been
12     negative on 2 tests at least 30 days apart with the first
13     test being no sooner than 30 days after the euthanasia or
14     isolation of all test-positive dogs.
15         (3) Any dog receiving antibiotics during the
16     quarantine period has been tested using the AGID or ELISA
17     test; and the type of antibiotic, dose given, and duration
18     of treatment has been provided to the Department.
19         (4) Dogs that have received no antibiotics for more
20     than 6 months have been tested using at least the card
21     test.
22         (5) All puppies from test-positive dams have been
23     isolated for 30 days post-weaning and subsequently test
24     negative on 2 tests at least 30 days apart.
