SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.148 new

    Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2009 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2010. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Section
5 2-3.148 as follows:
 
6     (105 ILCS 5/2-3.148 new)
7     Sec. 2-3.148. Trans fats ban.
8     (a) In this Section, "trans fats" means fats that are
9 artificially created through a chemical process involving the
10 hydrogenation of oils.
11     (b) The State Board of Education shall adopt rules for the
12 elimination of vegetable oils containing trans fats in foods
13 served in public school cafeterias beginning on July 1, 2009
14 and for the elimination of all foods containing trans fats from
15 public schools beginning on July 1, 2010, which ban shall
16 include without limitation all foods sold as part of the school
17 breakfast and lunch programs under the School Breakfast and
18 Lunch Program Act, foods sold in vending machines on school
19 grounds, and competitive foods sold during school hours.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
