AMENDMENT TO HOUSE BILL 261

2     AMENDMENT NO. ______. Amend House Bill 261 by replacing
3 everything from line 9 on page 2 through line 14 on page 3 with
4 the following:
 
5     "(20 ILCS 2505/2505-305)  (was 20 ILCS 2505/39b15.1)
6     Sec. 2505-305. Investigators.
7     (a) The Department has the power to appoint investigators
8 to conduct all investigations, searches, seizures, arrests,
9 and other duties imposed under the provisions of any law
10 administered by the Department, the Illinois Liquor Control
11 Commission, or the Illinois Racing Board or the Illinois Gaming
12 Board. These Except as provided in subsection (c), these
13 investigators have and may exercise all the powers of peace
14 officers only as provided in this Section. An investigator may
15 exercise the powers of a peace officer while solely for the
16 purpose of enforcing taxing or other measures administered by
17 the Department, the Illinois Liquor Control Commission, or the

1 Illinois Racing Board. An investigator may exercise the powers
2 of a peace officer when he or she discovers any criminal
3 offense or violation while enforcing any measure administered
4 by the Department, the Illinois Liquor Control Commission, or
5 the Illinois Racing Board if (i) the criminal offense or
6 violation creates a threat to the life or safety of the
7 investigator or any other person and (ii) the investigator
8 notifies the proper local law enforcement agency as soon as is
9 practical. or the Illinois Gaming Board.
10     (b) The Director must authorize to each investigator
11 employed under this Section and to any other employee of the
12 Department exercising the powers of a peace officer a distinct
13 badge that, on its face, (i) clearly states that the badge is
14 authorized by the Department and (ii) contains a unique
15 identifying number. No other badge shall be authorized by the
16 Department.
17     (c) The Department may enter into agreements with the
18 Illinois Gaming Board providing that investigators appointed
19 under this Section shall exercise the peace officer powers set
20 forth in paragraph (20.6) of subsection (c) of Section 5 of the
21 Riverboat Gambling Act. Investigators appointed under this
22 Section who are assigned to the Illinois Gaming Board have and
23 may exercise all the rights and powers of peace officers,
24 provided that these powers shall be limited to offenses or
25 violations occurring or committed on a riverboat or dock, as
26 defined in subsections (d) and (f) of Section 4 of the
