AMENDMENT TO HOUSE BILL 793

2     AMENDMENT NO. ______. Amend House Bill 793 on page 1, by
3 replacing line 5 with the following:
 
4 "Sections 1.02, 2.01, and 7 as follows:
 
5     (5 ILCS 120/1.02)  (from Ch. 102, par. 41.02)
6     Sec. 1.02. For the purposes of this Act:
7     "Meeting" means any gathering, whether in person or by
8 video or audio conference, telephone call, electronic means
9 (such as, without limitation, electronic mail, electronic
10 chat, and instant messaging), or other means of contemporaneous
11 interactive communication, of a majority of a quorum of the
12 members of a public body held for the purpose of discussing
13 public business or, for a 5-member public body, a quorum of the
14 members of a public body held for the purpose of discussing
15 public business.
16     Accordingly, for a 5-member public body, 3 members of the

1 body constitute a quorum and the affirmative vote of 3 members
2 is necessary to adopt any motion, resolution, or ordinance,
3 unless a greater number is otherwise required.
4     "Public body" includes all legislative, executive,
5 administrative or advisory bodies of the State, counties,
6 townships, cities, villages, incorporated towns, school
7 districts and all other municipal corporations, boards,
8 bureaus, committees or commissions of this State, and any
9 subsidiary bodies of any of the foregoing including but not
10 limited to committees and subcommittees which are supported in
11 whole or in part by tax revenue, or which expend tax revenue,
12 except the General Assembly and committees or commissions
13 thereof. "Public body" includes tourism boards and convention
14 or civic center boards located in counties that are contiguous
15 to the Mississippi River with populations of more than 250,000
16 but less than 300,000. "Public body" includes the Health
17 Facilities Planning Board. "Public body" does not include a
18 child death review team or the Illinois Child Death Review
19 Teams Executive Council established under the Child Death
20 Review Team Act; or an ethics commission acting under the State
21 Officials and Employees Ethics Act; or an elder abuse fatality
22 review team established pursuant to Section 15 of the Elder
23 Abuse and Neglect Act.
