1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Small Business Advisory Act is amended by | |||||||||||||||||||
5 | changing Section 10 as follows:
| |||||||||||||||||||

7 | Sec. 10. Small business advisory web pages site.
| |||||||||||||||||||
8 | (a) Within 6 months after the
the effective date of this
| |||||||||||||||||||
9 | Act, each Agency must create and make available on the World
| |||||||||||||||||||
10 | Wide Web a small business advisory page. | |||||||||||||||||||
11 | (b) Each agency that (i) has adopted or is preparing to
| |||||||||||||||||||
12 | adopt any rule affecting small businesses or (ii) is
designated | |||||||||||||||||||
13 | to administer legislation affecting small businesses that
has | |||||||||||||||||||
14 | become law must prepare and post on its small business
advisory | |||||||||||||||||||
15 | page a plain language explanation of the rule or legislation.

16 | The explanation must indicate the effective date of the rule or
| |||||||||||||||||||
17 | legislation. The explanation must remain posted for a minimum | |||||||||||||||||||
18 | of 6
months after the effective date of the rule or | |||||||||||||||||||
19 | legislation. Agencies shall
consult with the Department and | |||||||||||||||||||
20 | small businesses in developing uniform
web page standards.

21 | If a rule has been proposed but not adopted, an
explanation | |||||||||||||||||||
22 | of the rule must be posted as soon as possible in
order to | |||||||||||||||||||
23 | allow input and comment from affected small
businesses. The |

1 | State agency must, in
addition to posting a plain language | ||||||
2 | explanation of the rule,
post notice of the time, date, and | ||||||
3 | place of any public hearings,
together with the names, | ||||||
4 | addresses, and telephone numbers of the
agency rulemaking | ||||||
5 | contact; what must
be done by members of the public who wish to | ||||||
6 | provide testimony on the
rulemaking; and the names and | ||||||
7 | Springfield and district office addresses and
telephone | ||||||
8 | numbers of the members of the Joint Committee.

9 | (c) When each agency updates its small business advisory
| ||||||
10 | web page, it shall notify the Department. The
Department, | ||||||
11 | through its First Stop Business Information Center,
shall serve | ||||||
12 | as a central clearinghouse notifying the small
business | ||||||
13 | community of each agency's rulemakings and changes in
| ||||||
14 | requirements. Furthermore, the Department shall seek input | ||||||
15 | from
the small business community on the changes and inform the
| ||||||
16 | appropriate agency and where applicable, the Joint Committee,
| ||||||
17 | of the input.
| ||||||
18 | The Department, as a part of its clearinghouse function,
| ||||||
19 | shall maintain a central small business advisory web page that
| ||||||
20 | shall serve as a coordinated point of access to all agencies'
| ||||||
21 | business advisory web pages.
