AMENDMENT TO HOUSE BILL 3872

2     AMENDMENT NO. ______. Amend House Bill 3872 on page 1,
3 lines 5 and 6, by replacing "Section 2505-310" with "Sections
4 2505-305 and 2505-310"; and
 
5 on page 1, immediately below line 6, by inserting the
6 following:
 
7     "(20 ILCS 2505/2505-305)  (was 20 ILCS 2505/39b15.1)
8     Sec. 2505-305. Investigators.
9     (a) The Department has the power to appoint investigators
10 to conduct all investigations, searches, seizures, arrests,
11 and other duties imposed under the provisions of any law
12 administered by the Department, the Illinois Liquor Control
13 Commission, the Illinois Racing Board, or the Illinois Gaming
14 Board. These Except as provided in subsection (c), these
15 investigators have and may exercise all the powers of peace
16 officers only as provided in this Section. An investigator may

1 exercise the powers of a peace officer while solely for the
2 purpose of enforcing taxing or other measures administered by
3 the Department, the Illinois Liquor Control Commission, the
4 Illinois Racing Board, or the Illinois Gaming Board. An
5 investigator may exercise the powers of a peace officer when he
6 or she discovers any criminal offense or violation while
7 enforcing any measure administered by the Department, the
8 Illinois Liquor Control Commission, the Illinois Racing Board,
9 or the Illinois Gaming Board if (i) the criminal offense or
10 violation creates a threat to the life or safety of the
11 investigator or any other person and (ii) the investigator
12 notifies the proper local law enforcement agency as soon as is
13 practical.
14     (b) The Director must authorize to each investigator
15 employed under this Section and to any other employee of the
16 Department exercising the powers of a peace officer a distinct
17 badge that, on its face, (i) clearly states that the badge is
18 authorized by the Department and (ii) contains a unique
19 identifying number. No other badge shall be authorized by the
20 Department.
21     (c) (Blank). Investigators appointed under this Section
22 who are assigned to the Illinois Gaming Board have and may
23 exercise all the rights and powers of peace officers, provided
24 that these powers shall be limited to offenses or violations
25 occurring or committed on a riverboat or dock, as defined in
26 subsections (d) and (f) of Section 4 of the Riverboat Gambling
