AMENDMENT TO HOUSE BILL 3961

2     AMENDMENT NO. ______. Amend House Bill 3961 on page 1, line
3 5, by replacing "Section 5.2" with "Sections 5.2 and 14"; and
 
4 on page 32, by replacing lines 1 and 2 with the following:
5         "the Department, and any other agency within 60 days of
6         the date of service of the order as ordered by the
7         court unless a motion to vacate, modify, or reconsider
8         the order is filed pursuant to Section 12 of this Act;
9         and"; and
 
10 on page 33, line 23, by inserting "within 60 days of the date
11 of service of the order unless a motion to vacate, modify, or
12 reconsider the order is filed pursuant to Section 12 of this
13 Act" before the period; and
 
14 on page 37, by inserting immediately below line 19 the
15 following:

1     "(20 ILCS 2630/14 new)
2     Sec. 14. Expungement Backlog Accountability Law.
3     (a) On or before August 1 of each year, the Department of
4 State Police shall report to the Governor, the Attorney
5 General, the Office of the State Appellate Defender, and both
6 houses of the General Assembly the following information for
7 the previous fiscal year:
8         (1) the number of expungement petitions received by the
9     Department;
10         (2) the number of expungement petitions to which the
11     Department objected pursuant to subdivision (d)(5)(B) of
12     Section 5.2 of this Act;
13         (3) the number of petitions to seal records received by
14     the Department;
15         (4) the number of petitions to seal records to which
16     the Department objected pursuant to subdivision (d)(5)(B)
17     of Section 5.2 of this Act;
18         (5) the number of expungement orders received by the
19     Department;
20         (6) the number of expungement orders denied by the
21     Department;
22         (7) the number of expungement orders entered by the
23     Department;
24         (8) the number of orders to seal records received by
25     the Department;

1         (9) the number of orders to seal records denied by the
2     Department;
3         (10) the number of orders to seal records entered by
4     the Department;
5         (11) the amount of fees received by the Department
6     pursuant to subdivision (d)(10) of Section 5.2 of this Act
7     and deposited into the State Police Services Fund;
8         (12) the number of orders of expungement or to seal
9     records received by the Department that have not been
10     entered as of June 30 of the previous fiscal year.
11     (b) The information reported under this Section shall be
12 made available to the public, at the time it is reported, on
13 the official web site of the Department of State Police.".
