1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Section
5 27-1.5 as follows:
 
6     (105 ILCS 5/27-1.5 new)
7     (Section scheduled to be repealed on July 1, 2012)
8     Sec. 27-1.5. Instructional Mandates Task Force;
9 moratorium.
10     (a) The General Assembly recognizes the increasing number
11 of instructional mandates that it passes each year. The State
12 Board shall create the Instructional Mandates Task Force.
13     (b) The Task Force shall consist of the following voting
14 members:
15         (1) One member appointed by the Governor, who shall
16     serve as chairperson of the Task Force.
17         (2) One member appointed by the President of the
18     Senate.
19         (3) One member appointed by the Minority Leader of the
20     Senate.
21         (4) One member appointed by the Speaker of the House of
22     Representatives.
23         (5) One member appointed by the Minority Leader of the

1     House of Representatives.
2         (6) One member appointed by the State Superintendent of
3     Education.
4         (7) One district superintendent from a rural district
5     appointed by the Governor upon the recommendation of an
6     organization representing school administrators.
7         (8) One district superintendent from a suburban school
8     district appointed by the Governor upon the recommendation
9     of an organization representing school administrators.
10         (9) One district superintendent from a urban school
11     district appointed by the Governor upon the recommendation
12     of an organization representing school administrators.
13         (10) One school principal appointed by the Governor
14     upon the recommendation of an association representing
15     school principals.
16         (11) One member appointed by the Governor upon the
17     recommendation of an association representing special
18     education administrators.
19         (12) One member appointed by the Governor upon the
20     recommendation of an association representing school
21     boards.
22         (13) One member appointed by the Governor upon the
23     recommendation of the Chicago Board of Education.
24         (14) One member appointed by the Governor upon the
25     recommendation of an organization representing teachers.
26         (15) One member appointed by the Governor upon the

1     recommendation of a different organization representing
2     teachers.
3         (16) One member appointed by the Governor upon the
4     recommendation of an organization representing parents and
5     teachers.
6     Members appointed by the legislative leaders shall be
7 appointed for the duration of the Task Force. In the event of a
8 vacancy, the appointment to fill the vacancy shall be made by
9 the legislative leader of the same chamber and party as the
10 leader who made the original appointment.
11     (c) The Task Force shall explore and examine all
12 instructional mandates governing the public schools of this
13 State that currently exist and shall make recommendations
14 concerning, but not limited to, the propriety of all existing
15 mandates, the imposition of future mandates, and waivers of
16 instructional mandates. The Task Force shall ensure that its
17 recommendations include specifics as to the necessary funding
18 to carry out identified responsibilities.
19     (d) The Task Force may begin to conduct business upon the
20 appointment of a majority of the voting members.
21     (e) The State Board of Education shall be responsible for
22 providing staff and administrative support to the Task Force.
23     (f) Members of the Task Force shall receive no compensation
24 for their participation, but may be reimbursed by the State
25 Board of Education for expenses in connection with their
26 participation, including travel, if funds are available.

1     (g) The Task Force shall submit a final report of its
2 findings and recommendations to the Governor and the General
3 Assembly on or before July 1, 2011. The Task Force may submit
4 other reports as it deems appropriate.
5     (h) The Task Force is abolished on July 2, 2011, and this
6 Section is repealed on July 1, 2012.
7     (i) Beginning on the effective date of this amendatory Act
8 of the 96th General Assembly and until one year after the Task
9 Force submits a final report to the Governor and General
10 Assembly, there shall be a moratorium on the passage of
11 instructional mandates for public schools. For the purposes of
12 this Section, "instructional mandate" means any State law that
13 requires a school district to devote any amount of time to the
14 instruction of or engagement by students in any subject or
15 course.
 
16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
