SYNOPSIS AS INTRODUCED:
 
70 ILCS 1863/38

    Amends the Upper Mississippi River International Port District Act. Provides that the registered voters of a county included in the Upper Mississippi International Port District may petition the local election authority (now, State Board of Elections) requesting the submission of the question of whether the county should be disconnected from the District. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Upper Mississippi River International Port
5 District Act is amended by changing Section 38 as follows:
 
6     (70 ILCS 1863/38)
7     Sec. 38. Disconnection. The registered voters of a county
8 included in the District may petition the local election
9 authority State Board of Elections requesting the submission of
10 the question of whether the county should be disconnected from
11 the District to the electors of the county. The petition shall
12 be circulated in the manner required by Section 28-3 of the
13 Election Code and objections thereto and the manner of their
14 disposition shall be in accordance with Section 28-4 of the
15 Election Code. If a petition is filed with the local election
16 authority State Board of Elections, signed by not less than 5%
17 of the registered voters of the county or that portion of the
18 county that is within the District, requesting that the
19 question of disconnection be submitted to the electors of the
20 county, the local election authority State Board of Elections
21 must certify the question to the proper election authority,
22 which must submit the question at a regular election held at
23 least 78 days after the petition is filed in accordance with

1 the Election Code.
2     The question must be submitted in substantially the
3 following form:
4     Shall (name of county) be disconnected from the
5     Upper Mississippi River International Port District?
6 The votes must be recorded as "Yes" or "No". If a majority of
7 the electors voting on the question vote in the affirmative,
8 the county or portion of the county that is within the District
9 shall be disconnected from the District.

11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
