| AN ACT concerning criminal law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Criminal Code of 1961 is amended by changing |
5 |
| Section 20-2 as follows:
|

| (720 ILCS 5/20-2) (from Ch. 38, par. 20-2)

| Sec. 20-2. Possession of explosives or explosive or |
8 |
| incendiary devices.
|

| (a) A person commits the
the offense of possession of |
10 |
| explosives or
explosive or incendiary devices in violation of |
11 |
| this Section when he or she
possesses, manufactures or |
12 |
| transports
any explosive compound, timing or detonating device |
13 |
| for use with any explosive
compound or incendiary device
and |
14 |
| either intends to use such explosive or device to commit any |
15 |
| offense or
knows that another intends to use such explosive or |
16 |
| device to commit a
felony. |

| (b) Sentence.
|
18 |
| Possession of explosives or explosive or incendiary |
19 |
| devices in violation
of this Section is a Class 1 felony for |
20 |
| which a person, if
sentenced to a term of imprisonment, shall |
21 |
| be sentenced to not less than 4
years and not more than 30 |
22 |
| years.
