AMENDMENT TO HOUSE BILL 5301

2     AMENDMENT NO. ______. Amend House Bill 5301, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The State Finance Act is amended by adding
6 Section 5.755 as follows:
 
7     (30 ILCS 105/5.755 new)
8     Sec. 5.755. The Public Safety Diver Fund.
 
9     Section 10. The Illinois Vehicle Code is amended by adding
10 Section 3-689 as follows:
 
11     (625 ILCS 5/3-689 new)
12     Sec. 3-689. Public Safety Diver license plates.
13     (a) The Secretary, upon receipt of an application made in
14 the form prescribed by the Secretary of State, may issue

1 special registration plates designated to be Public Safety
2 Diver license plates. The special plates issued under this
3 Section shall be affixed only to passenger vehicles of the
4 first division, motor vehicles of the second division weighing
5 not more than 8,000 pounds, and recreational vehicles as
6 defined by Section 1-169 of this Code. Plates issued under this
7 Section shall expire according to the multi-year procedure
8 established by Section 3-414.1 of this Code.
9     (b) The design and color of the plates shall be wholly
10 within the discretion of the Secretary of State. Appropriate
11 documentation, as determined by the Secretary, shall accompany
12 the application. The Secretary may, in his or her discretion,
13 allow the plates to be issued as vanity or personalized plates
14 in accordance with Section 3-405.1 of this Code.
15     (c) An applicant shall be charged a $45 fee for original
16 issuance in addition to the appropriate registration fee, if
17 applicable. Of this fee, $30 shall be deposited into the Public
18 Safety Diver Fund and $15 shall be deposited into the Secretary
19 of State Special License Plate Fund. For each registration
20 renewal period, a $27 fee, in addition to the appropriate
21 registration fee, shall be charged. Of this fee, $25 shall be
22 deposited into the Public Safety Diver Fund and $2 shall be
23 deposited into the Secretary of State Special License Plate
24 Fund.
25     (d) The Public Safety Diver Fund is created as a special
26 fund in the State treasury. All moneys in the Public Safety

1 Diver Fund shall be paid, subject to appropriation by the
2 General Assembly and approval by the Secretary, to the Illinois
3 Law Enforcement Training Standards Board for the purposes of
4 providing grants based on need for training, standards, and
5 equipment to public safety disciplines within the State of
6 Illinois and to units of local government involved in public
7 safety diving and water rescue services.
8     (e) The Public Safety Diver Advisory Committee shall
9 recommend grant rewards with the intent of achieving reasonably
10 equitable distribution of funds between police, firefighting,
11 and public safety diving services making application for grants
12 under this Section.
13     (f) The administrative costs related to management of
14 grants made from the Public Safety Diver Fund shall be paid
15 from the Public Safety Diver Fund to the Illinois Law
16 Enforcement Training Standards Board.".
