Amends the Aid to the Aged, Blind,
or Disabled Article of the Illinois Public Aid Code. Requires a mechanism to exist which will allow certain medical assistance recipients required to receive care administered through an entity licensed under the Health Maintenance Organization Act or a third party administrator paid through a capitated payment rate, to opt out of such coverage and enroll in a fee-for-service based coverage, if certain conditions apply. Effective July 1, 2010.

| AN ACT concerning public aid.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
5 |
| changing Section 3-6 as follows:
|

| (305 ILCS 5/3-6) (from Ch. 23, par. 3-6)
|

| Sec. 3-6. Entitlement to medical assistance.
|
8 |
| (a) Persons qualified for financial aid for basic |
9 |
| maintenance shall be
entitled to receive, under Article V, all |
10 |
| necessary medical assistance.
|
11 |
| (b) If any persons entitled to receive medical assistance |
12 |
| under this Section are required to receive care administered |
13 |
| through an entity licensed under the Health Maintenance |
14 |
| Organization Act or a third party administrator paid through a |
15 |
| capitated payment rate at the same time that other persons |
16 |
| covered under this Section or Article V of this Code, or the |
17 |
| Children's Health Insurance Program Act or the Covering ALL |
18 |
| KIDS Health Insurance Act are able to access care through a |
19 |
| fee-for-service based system, then a mechanism shall exist |
20 |
| which allows such persons to opt out of the capitated or HMO |
21 |
| based coverage and to enroll in a fee-for-service based |
22 |
| coverage. |
