SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1301.8 new

    Amends the Illinois Vehicle Code. Provides that no property owner shall allow any unreasonable obstruction of a designated aisle or parking place specifically reserved for persons with disabilities after 24 hours following the conclusion of an adverse weather event. Provides that no property owner shall allow the accumulation of debris or large objects, such as trash containers, to unreasonably obstruct any designated aisle or parking place specifically reserved for persons with disabilities without providing suitable and equivalent alternative parking spaces on-site. Provides that a person who violates these provisions shall be guilty of a petty offense and pay fine of not more than $250. Effective January 1, 2011.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 11-1301.8 as follows:
 
6     (625 ILCS 5/11-1301.8 new)
7     Sec. 11-1301.8. Obstruction of parking places for persons
8 with disabilities.
9     (a) No property owner shall allow any unreasonable
10 obstruction of a designated aisle or parking place specifically
11 reserved for persons with disabilities after 24 hours following
12 the conclusion of an adverse weather event.
13     (b) No property owner shall allow the accumulation of
14 debris or large objects, such as trash containers, to
15 unreasonably obstruct any designated aisle or parking place
16 specifically reserved for persons with disabilities without
17 providing suitable and equivalent alternative parking spaces
18 on-site.
19     (c) This Section shall apply to both public and private
20 property where any designated aisle or parking place
21 specifically reserved for persons with disabilities, by the
22 posting of an official sign as designated under Section 11-301
23 of this Code.

1     (d) A person who violates this Section shall be guilty of a
2 petty offense and pay fine of not more than $250.
 
3     Section 99. Effective date. This Act takes effect January
4 1, 2011.
