1 | AMENDMENT TO HOUSE BILL 6439

2 | AMENDMENT NO. ______. Amend House Bill 6439 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Structural Pest Control Act is amended by | ||||||
5 | adding Section 10.15 as follows: | ||||||
6 | (225 ILCS 235/10.15 new) | ||||||
7 | Sec. 10.15. Findings and Council report. The General | ||||||
8 | Assembly makes the following findings: | ||||||
9 | (1) The quality of life for a growing number of | ||||||
10 | Illinois families has
been impacted by a significant | ||||||
11 | increase in bed bug (Cimex lectularius)
infestations. | ||||||
12 | (2) A joint EPA/CDC statement recognizes bed bugs as a
| ||||||
13 | pest of public health importance. | ||||||
14 | (3) Bed bug infestations are increasing, are
difficult | ||||||
15 | to abate, and pose a challenge to those affected by those
| ||||||
16 | infestations. |

1 | (4) There is a lack of public awareness about
bed bug | ||||||
2 | prevention, management, and control, necessitating the
| ||||||
3 | need for education of consumers, tenants, landlords, | ||||||
4 | property owners, and
managers. | ||||||
5 | (5) In April of 2009, the United States Environmental
| ||||||
6 | Protection Agency held its first National Bed Bug Summit to
| ||||||
7 | solicit recommendations on dealing with the growing public
| ||||||
8 | nuisance of bed bugs; among the major recommendations
| ||||||
9 | emanating from the summit was the importance of legislative
| ||||||
10 | support and better education about bed bugs for governments
| ||||||
11 | and elected officials. | ||||||
12 | (6) It is in the public interest to
study the increase | ||||||
13 | in bed bug infestations and make
specific recommendations | ||||||
14 | for addressing this growing public
nuisance. | ||||||
15 | The Structural Pest Control Advisory Council shall convene | ||||||
16 | a
subcommittee to develop a report to the General Assembly with
| ||||||
17 | recommendations on the prevention, management, and control of | ||||||
18 | bed bug
infestations. The report shall include, but not be | ||||||
19 | limited to,
recommendations related to the availability of | ||||||
20 | education materials on
bed bug prevention, management, and | ||||||
21 | control; proper transport, storage,
and disposal of bed bug | ||||||
22 | infested materials; promote the development of
effective | ||||||
23 | treatment methods or options to eradicate bed bug
infestation; | ||||||
24 | and increasing knowledge and awareness among tenants,
| ||||||
25 | landlords, and property managers and owners about preventing | ||||||
26 | bed bug
infestations. |

1 | In addition to the members of the Structural Pest Control | ||||||
2 | Advisory
Council, the subcommittee may include: a | ||||||
3 | representative of a nonprofit
organization, particularly one | ||||||
4 | involved with tenant advocacy issues; a
representative of | ||||||
5 | apartment associations; and staff from the Illinois
Housing | ||||||
6 | Development Authority and the Office of the Illinois Attorney | ||||||
7 | General. The
members of the subcommittee shall serve without | ||||||
8 | compensation for their
duties or expenses incurred with the | ||||||
9 | work of the subcommittee. | ||||||
10 | The Structural Pest Control Advisory Council shall issue | ||||||
11 | its
report to the General Assembly on or before December 31, | ||||||
12 | 2011.

13 | Section 99. Effective date. This Act takes effect upon | ||||||
14 | becoming law.".
