SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.755 new
625 ILCS 5/3-689 new

    Amends the Illinois Vehicle Code and State Finance Act. Provides for the issuance of Sons of the American Legion special license plates. Provides that an applicant shall be charged an additional fee of $15 at original issuance and an additional $10 upon renewal. Provides that $5 of the original issuance fee and renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the original issuance fee and $5 of the renewal fee shall be deposited into the Sons of American Legion Scholarship Fund. Creates the Sons of American Legion Scholarship Fund as a special fund in the State treasury. Provides that all moneys in the Sons of the American Legion Scholarship Fund shall, subject to appropriation, be used for grants for scholarships for Illinois residents who are children of members of the Sons of the American Legion and who meet the academic, financial, and other requirements established by the Sons of the American Legion. Provides that all grants must be used at a college or university in Illinois.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 5.755 as follows:
 
6     (30 ILCS 105/5.755 new)
7     Sec. 5.755. The Sons of the American Legion Scholarship
8 Fund.
 
9     Section 10. The Illinois Vehicle Code is amended by adding
10 Section 3-689 as follows:
 
11     (625 ILCS 5/3-689 new)
12     Sec. 3-689. Sons of the American Legion license plates.
13     (a) The Secretary, upon receipt of an application made in
14 the form prescribed by the Secretary, may issue special
15 registration plates designated as Sons of the American Legion
16 license plates. The special plates issued under this Section
17 shall be fixed only to passenger vehicles of the first
18 division, motor vehicles of the second division weighing not
19 more man 8,000 pounds, and recreational vehicles as defined in
20 Section 1-169 of this Code. Plates issued under this Section
21 shall expire according to the multi-year procedure established

1 by Section 3-414.1 of this Code.
2     (b) The design and color of the plate is wholly within the
3 discretion of me Secretary, except that the phrase "Sons of the
4 American Legion", and the official Emblem of the Sons of the
5 American Legion shall be on the plates. The Secretary may allow
6 the plates to be issued as vanity plates or personalized plates
7 under Section 3-405.1 of the Code.
8     A series of letters and numbers shall be reserved for
9 special plates issued pursuant to this Section to past
10 detachment commanders of the Sons of the American Legion. The
11 series of letters and numbers reserved under this Section shall
12 have the prefix of "PDC" and be followed by two numerals
13 ranging from 00-99 that designate the year that the past
14 detachment commander last served. For example, "PDC 08" would
15 identify the past detachment commander that last served during
16 the year 2008. Certification by the detachment adjutant will be
17 required in the form of a letter verifying service dates of the
18 past detachment commander for issuance of the special plate.
19     (c) An applicant for the special plate shall be charged a
20 $15 fee for original issuance in addition to the appropriate
21 registration fee. Of this additional fee, $10 shall be
22 deposited into the Sons of the American Legion Scholarship Fund
23 and $5 shall be deposited into the Secretary of State Special
24 License Plate Fund, to be used by the Secretary to help defray
25 the administrative processing costs.
26     For each registration renewal period, a $10 fee, in

1 addition to the appropriate registration fee, shall be charged.
2 Of this additional fee, $5 shall be deposited into the Sons of
3 the American Legion Scholarship Fund and $5 shall be deposited
4 into the Secretary of State Special License Plate Fund.
5     (d) The Sons of the American Legion Scholarship Fund is
6 created as a special fund in the State treasury. All moneys in
7 the Sons of the American Legion Scholarship Fund shall be paid,
8 subject to appropriation by the General Assembly and approval
9 by the Secretary, as grants for scholarships for higher
10 education. The scholarship recipients must be the children of
11 current or former members of the Sons of the American Legion
12 who meet the academic, financial, and other requirements
13 established by the Sons of the American Legion. In addition,
14 the recipients must be Illinois residents and must attend a
15 college or university located within the State of Illinois.
