AMENDMENT TO HOUSE JOINT RESOLUTION 39

2     AMENDMENT NO. ___. Amend House Joint Resolution 39 as
3 follows:
 
4 on page 1, line 21, immediately after "has", by inserting
5 "twice"; and
 
6 on page 2, by replacing line 1 with the following:
7 "funding shortages, the current shortage requiring applicants
8 for"; and
 
9 on page 2, by replacing lines 15 through 17 with the following:
10     "WHEREAS, The cost of an average leaking underground
11 storage tank site where costs are reimbursed from the Fund is";
12 and
 
13 on page 2, immediately below line 18 by inserting the
14 following:

1     "WHEREAS, Current law does not contain adequate methods for
2 monitoring and controlling costs at leaking underground
3 storage tank sites where costs are reimbursed from the Fund;
4 and"; and
 
5 on page 3, by replacing line 10 with the following:
6 "costs of clean-up of leaking underground storage tank sites;
7 and be it further"; and
 
8 on page 4, lines 3, 5, 8, and 10, by inserting "of the Illinois
9 Environmental Protection Agency" immediately after "Director"
10 each time it appears; and
 
11 on page 4, by inserting the following after line 12:
12     "RESOLVED, That the approaches studied by the Task Force
13 shall include, but shall not be limited to, the following:
14         (1) In order to prevent the recurrence of a backlog of
15     unpaid claims, requiring that the total costs approved for
16     reimbursement from the Fund not exceed the monies in the
17     Fund available to pay the costs;
18         (2) Requiring that costs reimbursed from the Fund be
19     minimized to the greatest extent practicable, including,
20     but not limited to, utilization of the Illinois Pollution
21     Control Board's risk-based corrective action rules to the
22     greatest extent practicable;
23         (3) Requiring that costs that will be reimbursed from

1     the Fund be pre-approved by the State before they are
2     incurred;
3         (4) Prioritizing approvals of costs that will be
4     reimbursed from the Fund so that (1) sites posing a greater
5     threat to human health and the environment receive higher
6     priority than sites posing a lesser threat to human health
7     and the environment, and (2) sites with operating
8     underground storage tanks at the time of the release
9     receive higher priority than sites without operating
10     underground storage tanks at the time of the release;
11         (5) Competitive bidding of costs that will be
12     reimbursed from the Fund, with such bidding including, but
13     not being limited to, public notice of bid proposals; and
14     be it further".
