    Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

    Section 5. The Public Utilities Act is amended by changing

Section 9-211 as follows:

    Sec. 9-211. 
The
The Commission, in any determination of

rates or charges,
shall include in a utility's rate base only

the value of such investment
which is both prudently incurred
