1 | AMENDMENT TO SENATE BILL 853

2 | AMENDMENT NO. ______. Amend Senate Bill 853 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Environmental Protection Act is amended by | ||||||
5 | adding Section 22.60 as follows: | ||||||
6 | (415 ILCS 5/22.60 new) | ||||||
7 | Sec. 22.60. Asphalt shingle disposal. | ||||||
8 | (a) Beginning January 1, 2013, no person shall knowingly | ||||||
9 | dispose of
asphalt roofing shingles in any municipal solid | ||||||
10 | waste landfill unit, nor shall any owner or operator of a | ||||||
11 | municipal solid waste landfill unit accept any asphalt roofing | ||||||
12 | shingles for final disposal, except that asphalt roofing | ||||||
13 | shingles may be disposed of, accepted for final disposal, or | ||||||
14 | both if either one one of the following conditions apply: | ||||||
15 | (1) The asphalt roofing shingles contain substances or | ||||||
16 | materials which
prohibit the reuse of the shingles. |

1 | (2) The asphalt roofing shingles are processed through | ||||||
2 | a permitted
construction and debris recycling facility. | ||||||
3 | (b) For the purposes of this Section, "asphalt roofing | ||||||
4 | shingles" include organic asphalt shingles, laminated organic | ||||||
5 | asphalt shingles, and fiberglass asphalt shingles removed from | ||||||
6 | existing residential structures.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.".
