SYNOPSIS AS INTRODUCED:

    Amends the Illinois Municipal Code. Provides that a municipality shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act for use by the municipality have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Limits home rule powers. Amends the School Code. Provides that a school board shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act that are used for the practice driving part of a driver education course offered by the school district have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Provides for the waiver of the Vehicle Identification Number requirements imposed under this Section. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning vehicle identification.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Municipal Code is amended by adding
5 Section 11-40-4 as follows:
 
6     (65 ILCS 5/11-40-4 new)
7     Sec. 11-40-4. American-made vehicles. A municipality shall
8 require that all vehicles purchased or leased on or after the
9 effective date of this amendatory Act of the 96th General
10 Assembly for use by the municipality have a Vehicle
11 Identification Number that begins with the number one, the
12 number 4, or the number 5. A municipality may not regulate the
13 purchase or lease of vehicles in a manner less restrictive than
14 as provided in this Section. This Section is a limitation under
15 subsection (i) of Section 6 of Article VII of the Illinois
16 Constitution on the concurrent exercise by home rule units of
17 powers and functions exercised by the State.
 
18     Section 10. The School Code is amended by adding Sections
19 10-20.46 and 34-18.37 as follows:

1 school board shall require that all vehicles purchased or
2 leased on or after the effective date of this amendatory Act of
3 the 96th General Assembly that are used for the practice
4 driving part of a driver education course offered by the school
5 district under Section 27-24.2 of this Code have a Vehicle
6 Identification Number that begins with the number one, the
7 number 4, or the number 5.
8     School districts on the financial watch, the financial
9 early warning, or the financial difficulty list, as defined by
10 the State Board of Education, may waive the requirements of
11 this Section following (i) a public hearing and (ii) an
12 affirmative vote of at least two-thirds of the school board
13 members of the district to waive the requirements. Any district
14 waiving the requirements imposed under this Section shall
15 notify the State Board of Education within 45 days after the
16 wavier.
 
17     (105 ILCS 5/34-18.37 new)
18     Sec. 34-18.37. American-made driver education vehicles.
19 The board shall require that all vehicles purchased or leased
20 on or after the effective date of this amendatory Act of the
21 96th General Assembly that are used for the practice driving
22 part of a driver education course offered by the school
23 district under Section 27-24.2 of this Code have a Vehicle
24 Identification Number that begins with the number one, the
25 number 4, or the number 5.

1     School districts on the financial watch, the financial

10     Section 90. The State Mandates Act is amended by adding
11 Section 8.33 as follows:
 
12     (30 ILCS 805/8.33 new)
13     Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
14 of this Act, no reimbursement by the State is required for the
15 implementation of any mandate created by this amendatory Act of
16 the 96th General Assembly.
 
17     Section 99. Effective date. This Act takes effect upon
18 becoming law.
