Amends the Children with Disabilities Article of the School Code. In a Section requiring school districts to establish and maintain such special educational facilities as may be needed for children with disabilities, allows a school district to contract for administrative services or alternative facilities in order to comply with the requirements of the Article. Effective immediately.

| AN ACT concerning education.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The School Code is amended by changing Section |
5 |
| 14-4.01 as follows:
|

| Sec. 14-4.01.
Special educational facilities for
children |
8 |
| with disabilities.
School boards of any school districts that |
9 |
| maintain a recognized
school, whether operating under the |
10 |
| general law or under a special
charter, subject to any |
11 |
| limitations hereinafter specified, shall
establish and |
12 |
| maintain such special educational facilities as may be
needed |
13 |
| for children with disabilities as defined in
Section 14-1.02 of |
14 |
| this Article who are residents of
their school district, and |
15 |
| such children, residents of other school
districts as may be |
16 |
| authorized by this Article. A school district may contract for |
17 |
| administrative services or alternative facilities in order to |
18 |
| comply with the requirements of this Article.

| All such school boards shall place or by regulation may |
20 |
| authorize the
director of special education to place, pursuant |
21 |
| to procedures required
by this Act and rules and regulations |
22 |
| promulgated by the State Board of
Education, eligible children |
23 |
| into special education programs designed to
benefit children |
