SYNOPSIS AS INTRODUCED:

    Amends the Nursing Home Care Act. Provides that a notice of penalty sent to a facility must contain a detailed computation showing how the amount of the penalty was derived, including the number of days and the number of residents on which the penalty was based. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by changing
5 Section 3-307 as follows:
 
6     (210 ILCS 45/3-307)  (from Ch. 111 1/2, par. 4153-307)
7     Sec. 3-307. The Director may directly assess penalties
8 provided for under Section 3-305 of this Act. If the Director
9 determines that a penalty should be assessed for a particular
10 violation or for failure to correct it, he shall send a notice
11 to the facility. The notice shall specify the amount of the
12 penalty assessed, the violation, and the statute or rule
13 alleged to have been violated, and shall inform the licensee of
14 the right to hearing under Section 3-703 of this Act. The
15 notice must contain a detailed computation showing how the
16 amount of the penalty was derived, including the number of days
17 and the number of residents on which the penalty was based. If
18 the violation is continuing, the notice shall specify the
19 amount of additional assessment per day for the continuing
20 violation.
